Please tell me what you would expect in this sit- injury at school.

Lunchtime, ds1 placed in a headlock and head banged on ground. lost eyesight for 40 seconds approx, headache, bruising.

Teacher aware of all this.

If his TA was back I'd be OK (we are in the midst of an appeal for lunchtime funding) but she sin't

so i think he is home until she returns at least

How come HIS TA has been sent on a school trip away - surely she is there to help HIM rather than as a general TA (assuming he is statemented).

I would have reported this school to Ofsted ages ago (at the foot incident I think). Copy the letter to the LEA too.

I would also - if I were table to - remove my children and write to the LEA to inform them of your decision to do this by writing to tehm listing every incident and say that they are clearly failing in their duty of care towards their pupils and that as you cannot be assured that your children will be safe whilst they are with you then you will not be leaving them at the school until safety procedures have been thoroughly reviewed and improved.

As for the head injury they should have called A&E with those kinds of symptoms. No doubt about it IMO.

What a bunch of idiots. Makes me so on your behalf.

He only gets ten hours so he shares though AFAIK there are no kids using her in the group- the new Head made all non sattement paid for TA's redundant at Christmas. So someone has to go I guess. LAst time she went was when he went for ds2.

I have recently done a St Johns paediatric first aid course and a near identical scenario was discussed.For a head injury like this in a school/nursery/childminding situation.You should call 999 and then inform parents straightaway.

The NHS lady used to be a school nurse and was obviously annoyed too

Until tehn DS hadn't told us that he had asked to go home. I am making a complaint to Estyn (EWlesh Ofsted) tomorrow

You say they have in the past refused to show you the accident book. They are required by law to show you any entry in the accident book relating to your children. If they try to refuse, kick up a fuss. If they still refuse, call the LA and complain. They should know the law and should tell the school that they have no choice in the matter.

Almost any head injury should result in the patient going to hospital. If the patient has lost sight, even for a few seconds, that is straight to hospital. To do anything else is taking an appalling risk with the patient's life.

From the incidents you describe involving your other children, I think there may well be grounds for taking action against the school for negligence. That won't help your relationship with the school but it might force them to start looking after children properly. If your description is accurate there is something seriously wrong at that school.

You should certainly write a clear statement of this incident and the other incidents you mention and send copies to Ofsted, the LA and the Governors.

truth be told there is stuff I ahve left oput rather than the reverse sadly, 'minor' incidents

I have put it in writing to them that I wish to see the accident entry and be provided with a copy. LAsst time I did that theywn ouldnt but gave me a letter, it was only when i got the letter that I found out the incident I was asking about (DS1 caused but i;ve never hidden his as aggression on here) had invovled hurting 3 otehr children before he got to ds2.

I met with an AS specilaist recently and she checked nothing had been filed with any official bods at LEA about his agrression or anything, and a recent review was delayed and postponed becuase althouigh school admitted his aggression at lunchtimes they had no apperwork at all. it's not a once off by any means

Am useless at getting angry but will ahve to this time. Esp. as my baby is still not back yet

as a former lawyer I agree with considering a case for negligence against the school. this isn't a kid gets a greenstick fracture after falling over when playing football scenario (i.e. relatively straightforward injury, true accident) but the sort of f*ckwitnedness that Health and Safety is geared towards preventing.

ATM ds1 and ds2's classes are kept separate on different play yuards but nothing ahs been done tyo stop him harming anyone else, tehy just know I probaly wont find out about those incidents.

Am going to see if I can speak to CAB about it all, woulod they eb able to help lcoally do you think?

Clari - I was thinking of negligence more in relation to DS3 and the mouth (would prompt treatment have meant a better outcome?), and DS2 and the foot, though even if this incident isn't too concerning, there could be an argument as to school's lack of support impacting directly on DS1's mental health.

I wouldn't bother with CAB, but would look for a reputable legal aid solicitor. (www.legal500.com)

you don't have to contemplate pursuing any claim at all, if you decide it's a battle you don't want. with regard to any legal advice on DS1, that would be better dealt with by someone specialising in educational law. SOS/SEN might be a good starting point. Also may be worth putting out a shout for WetAugust on SN board, who seems very experienced in this sort of stuff.

I can't help feeling that they might fake the accident book entry now they know you want to see it.

When ds1 was being bullied and was left with bruises and scratches I was told he mustn't have told the teacher as there was nothing in the book. I believed her and felt a bit but now I am suspicious.

I hope you ds us home soon and is okay.

I agree with RatherBeOnThePiste. In addition to complaining to governors, you need to log an official complaint with Ofsted. Particularly in light of previous incidents which haven't been sorted out properly.

That is awful and I can't believe how bad that school sounds!

I agree wholeheartedly with everyone about making complaints and demanding paperwork, although I do think Fab has a point about falsifying entries. The school and staff sound like they are more than capable of doing so.

A few weeks ago DS fell whilst running at lunch time. He scuffed half his face and had a massive fat lip. They called me immediately to collect him, but heavily recommended that I take him to the dentist as they thought he had damaged his teeth. They were adamant that he needed to see the dentist (he was given the all clear thankfully).

That incident is nothing compared to what your DS suffered. I think TotaChaos has given some good advice. I hope you take up the advice and make some very large waves to get some improvements!

Please keep us updated on DS and what Esrtyn say.

I appreciate that I'm probably stating the obvious but are these people idiots!? The first thing i do with a head injury of that sort (obviously not a mildly bumped head) is phone the parents to see what they want to do. If nothing else it means I've passed the responsibility on to the parent who can make a choice they are happy with.

I've called for the emergency services in the past and been criticized for it but I really don't care. Don't care if it looks bad when the abulance arrives, don't care if it costs money, don't care if it is disruptive. Child is hurt + Lack of expert medical knowledge and medical scanner = child to hospital if parents cann't be contacted. End of.

Just spoke to them, hasn't been seen yet so am assuming all is well and triage happy

I need to read through all teh things tomorrow when less worried I think and decide what next apaprt from Esytyn and also LEA as this surely is evidence he isn't OK there?

Are the school idiots- think it's more complex than that; have a bad rep for never taking SN students, but we got in on a compulsory catchment acceptance rule (everyone in a tinya rea gets in, ewveryone else screened- was setup whens chool founded)- sort fo Church but not iyswim.

Vicar. Might go there, friend did and he was a massive help adn he was my lecturer at Uni.
