School offer accepted but landlord asking us to vacate before September

We are currently in a rental house and applied for school for reception. We got the school requested and we accepted the same. But now our landlord is asking us to vacate the property before the term begins (legal as per the agreement). What happens to the school offer? We liked the school and wanted to proceed in the same school. Is there any options available for us?

I think it depends on your council rules. What are your housing options? Will you be trying to rent locally? Do you need a reference. In a worst case scenario you could just stay put and have them formally evict you by which time school will of started. I’d assume you’d never get another private rental though.

I’m our area as long as this was your main home (and not rented temporarily for manipulating the school admissions) you keep the school place. But in some areas there are stricter rules.
I would find a new rental nearby if possible and inform the council. If it becomes an issue, involve a local councillor, because even if they do have stricter rules the aim is to stop people with money gaming the system, not to disadvantage children with less secure housing.

I wouldn't say anything just explain change of address after you moved I moved before he started and never had a problem

This happened to me and because we moved outside of the school catchment we were automatically moved to the new school in the new catchment area.

Thanks much for the response. We don’t have any other home and this we rented privately. We already started looking for rental accommodations in the same area but couldn’t find any in the catchment yet.

How stressful for you, sorry yo hear that.

For now you don't need to do anything re the school place. You applied to the school at your current address in good faith and it is still your address for now. You've done nothing wrong, your application was not fraudulent if that's what you fear they will think if your address changes.

You have a little while to try and find somewhere else to live. Obviously if you're happy with the school and the area your priority will be to try and find somewhere else local enough for him to still attend. If you end up too far away for this to be possible, you'll have to contact admissions to make a new application to change his place to elsewhere. His current school place will remain his until you accept a place at a different school, regardless of where you live. Addresses only matter when first applying. As long as you can prove you lived there when the application was made (which obviously you can as you still live there now, upon accepting the place) the place is his, they won't kick him out for potentially moving slightly further away than someone else who potentially missed out if that's what you're worried about. People move around all the time and many pupils who attend the school will live slightly further out now from when they first applied and were offered a place.

The only thing stopping him from attending that particular school is if you unfortunately can't find anywhere else to live local enough to easily get him there. In that situation, you will be able to see on your council's website which schools still have places for September, should you move somewhere further out where a new application needs to be made.

Good luck

In England, your place cannot be taken away simply because you move. Some LAs may try, but it is against the admissions code so a place removed this way should be returned on appeal.

The exception would be if they suspect your current rental address was an address of convenience, simply taken to get a school place - if you own or rent another property nearby,
For example. Given you presumably do not, and can evidence that you have been asked to vacate, you should be fine.
