Primary school appeal Year 6 !

Hi,
Help needed please re primary school appeal for a year 6 place.
myself and my husband and 3 children are moving home out of area. we have found school we really like and have managed to secure a place in year 3 for one of our sons my other son is in year 6 and that year is full. we are going through the appeals process can anyone give any advice? we are currently awaiting a day for our appeal to be heard.

We are hoping the fact one of our sons has been offered a place and the fact our eldest only has a few months left at school they might allow him in. there is only one other school in the area with spaces and its not a great school and having to do 2 separate school runs and a nursery run would be impossible. we both work so drop offs/pick ups land with grandma!
The school is an academy if that makes any difference.

Any advice appreciated.

It is a risk. Maybe better to accept the place in the meantime as any appeal will take a while even if successful. Do either have breakfast and/or after school care? It is only for a few months after all. Is he on the waiting list?

Having done an unsucessful secondary appeal, i wouldnt bother - especially for y6.
Even with strong reasons we didnt succeed.
Take the worse school its like 8 months, but they dont do any work after start of may

Your son being at the school isn't relevant for appeal, nor is the fact that there are only a few months left. Transport issues and the relative quality of the school is also irrelevant.

To win, you need to show that the disadvantage to your child from not being admitted outweighs any problems the school will face in coping with an additional pupil. You need to identify things this school offers that are particularly relevant to your son and that are not available at the school with places. For example, if your son is musically talented and this school offers a lot of extracurricular musical activities but the other school doesn't, that would be part of your case.

In a similar situation, we put both kids in school 2.
I wasn't prepared to have DS1 out of school or do 2 school runs. So school 2 is was as they could take both kids.
It was the "worst" school in town - hence having two spaces. And was fabulous.

None of your reasons are legitimate appeal reasons, imo.

Remember that once your younger DC attends the school, your oldest will be able to move up the waiting list anyway because of sibling allocation

Look at school policy for entry requirements and I thought if you moved into an area children had to be accommodated even if year was full

The LA must find a place somewhere, but it doesn't have to be at the school the parents want.

Thanks all the school we want the children to attend has both breakfast and after school wrap around care which we need due to work however the other school only has breakfast club.

we wouldn't send both children to the lesser school if the appeal fails.

Most y6 kids dont go to breakfast/afterschool clubs.
Here they walk to and from school. You might find another parent who sends them to the other school who could drop him gpback home? Or a child minder etc.
How much would a bus or taxi be for just the rest of the year or until her gets into the youngests school?

Update
Got my son his year 6 place at the school we wanted. We got sent a date for an appeal wrote our appeal letter and a week or so later got a phone call from the school offering a place as they said that we would have most likely win the appeal and offering a place sooner meant it was better for both children to start school on the same day rather than waiting for the appeal date and having the boys at different school and starting on different days.

Over the moon so anyone thinking they aways reject appeals I'm proof that it's not the case 😊
