Appeal denied/unsuccessful

I moved after the admissions round and had a sibling at a school i applied for but didn't start until 2 days after i moved in on 19th April. My son didn't get a place so i appealed and it was a class size appeal (not like you get a choice of what your appealing for) the pan is 30 and it was on video call with 5 other parents competing. None of us stood a chance as there was also a child with a echp so that took it to 31. My only catchment area school is full couldn't get either of my kids in at all i was offered a school 2.3 miles away and i was 2nd for all 3 schools now hes still second for my 1st choice and 1st for the other 2 schools. But if my son got a place at our catchment school the council said they would not let my daughter move schools. Thats not fair cant win either way I'll defer my son until he gets a place at his sisters school or the neighbouring school across the road im not picky at all just want it easier as im disabled and cant walk far i put this in my appeal i have progressive ms and it was denied.

Unfortunately it is very hard to win an infant class size appeal. Even if there had not been a child with an ECHP you would not have been offered a place. You have done the right thing by going on waiting lists for other schools. Did you accept the place at the school you were offered? So if he is a summer birthday deferment could be your best option giving more time for a more suitable place to crop up. Your waiting list places sound hopeful, you are in a good position.

I don’t think the LA can say you can’t move your daughters school, if your younger child is offered a place at a waiting list school you would be entitled to apply for a place for her , and if they had a place they would have to offer it. Unfortunately if she was in Y1 or 2 you would come up against the infant class size rule again. If she is older it is easier to appeal even if the school is full.

I am in an area where there just one main big catchment school but its so over full id of preferred my kids in this school its walking distance of 15 mins. I didn't even get to put in my preferences at all im hoping that now the appeals have been heard people might either move away or take other school places between now and september. Ive done this 2 year previously she didnt get any of her schools so waited 2 weeks after september she got a place but now im back in this same boat. Im not even going to respond to the place offered

You have nothing to gain by not accepting the offered place, but could lose having a place at all. Accepting it doesn’t have any impact on your chances of a space from the waiting list.

Do you know where you are on the waiting list?

In your previous thread you referred to a place being offered then withdrawn, but then offered again as it had been withdrawn in error. What happened to that place?

And the LA can't refuse to let your daughter move if a space is available in her year and she is top of the waiting list.

What they won't do is make an extra place for her just because her brother gets in. You could of course appeal for her place at that point.

You stated in May that he had a place, has that changed? It seems very confusing as you moved after the initial deadline and your change of address was not accepted in time to affect the allocation. Where is on wl for your dd's school? If he has a place at a different school now put her on the wl there.

He got offered a place but withdrew it thats why i appealed the councils did not communicate well i am confused as they said it was given in error there was confusion over when my daughter started school she was offered a place in feb but because she didn't start until april they withdrew my sons place as the sibling rule didn't apply which i understand. Like i said im not spitting my dummy out over not getting a first choice school its the stress of not getting any of the closest schools im not picky I'll see what happens with the waiting lists i shouldnt of appealed as it was a waste of time i know now that class size appeals are hard to win i thought i was appealing for other reasons. One being i didnt get to apply like everyone else as there was an error on the website which would let me add schools outside the borough but oh well never mind
