Risk Assessment for my DDs return to school, what if she fails?

Basically the above. DD is 6, year 2

In December DD was off school for an operation. She couldn’t return in December before Christmas due to the operation she had. She missed 12 school days.

Had an email just before Christmas from the headteacher saying that due to the reasons DD has been off and the length of the absence she has to do a risk assessment this week to see if she’s able to return as planned on 6th January.

So my questions;

  1. Is this normal?
  2. If DD doesn’t pass the risk assessment what happens?

I suspect DD won’t pass, she has other medical issues and this to me seems a convenient excuse to not have her return (DD has some toileting issues, but no EHCP so that takes TA time).

Is this even legal?

School is Volunteer Aided if that’s any help. Up to now they’ve been great with her additional needs and she has no behaviour issues in class. I have anxiety so could be overthinking everything.

I would seek advice from sendiass but if they do sound no to her being in it will be an illegal exclusion.

More than likely the RA will be to ensure any reasonable adjustments are in place to maintain her safety

Thank you thats reassuring, like I said I'm sure I'm overthinking it as I always do.

Your DD cannot "fail" a risk assessment. It's a check to see whether the school is safe for your DD. If it isn't, then the school might fail the risk assessment and then has to put measures in place to ensure that it is a safe place for your DD and that adjustments and precautions have been put into place.

A risk assessment is there to make sure the right procedures are in place and to help her in her return, it shouldn't be used to stop hers from returning

The risk assessment is just to ensure that all staff know what measures need to be in place to keep your DD safe - it’s not something she can fail, it’s an assessment of the school environment and procedures, not your DD. I hope she’s feeling better.

I have written risk assessments for all children who might find the return to school more difficult than in general, because of health issues or special needs or behavioural issues, a whole host of reasons. In each case it is to ensure that measures are put in place to keep the child safe and ease the return as much as possible. It is NOT a means of keeping children out of school.
