IF A SCHOOL IS UNDERSUBSCRIBED DO THEY HAVE TO ACCEPT A CHILD?

I’m currently about to appeal an in-year admission appeal for my daughter who is in year 5 and been refused a place at our school which is 0.4 miles away. We have relocated to the area. My question is, the school that has refused her is undersubscribed, does this mean they have to accept her? Or give me a better chance of winning the appeal?

Why have they refused her a space?
it maybe they are running less than their PAN for a reason agreed with the LA (building work etc) but usually it is in a schools interest to be full as money is roughly by head..
does she have needs they think they can't meet? again that is a different case.....

Is it undersubscribed in year 5?

Do they have a space in that class? Does it have mixed-age classes because that can affect it going forward.

My understanding is a school can be undersubscribed so reception has places but there are no places left in other years? Are there definitely places in the class you need? My local school has 5 reception spaces but the upper classes are over 30.

Yes, if they have a space in the at the school, and in the year, that is empty, then they must admit the child, as long as it won't cause a problem in a future class group (future prejudice) if they use mixed year group classes.

My DD was refused a place at a school which was very under subscribed. Her class in particular had 5 spaces however it had a higher than usual ratio of very badly behaved/disruptive students and had 2 extra TA's as a result. We did get in on appeal though.

Aah ok. It’s a mixed class of year 5 and 6, she’s been refused as although the PAN is 45 they only have 38, but was refused due to the way they arrange their classes. The school is undersubscribed.

I think that might be a future prejudice situation.
Ie the class 5/6 is currently undersubscribed, but next year with the current year 4 mixing with the current year 5 it will be over numbers.
I might be wrong though.

If they are undersubscribed in Y5 they are required to accept her. If they have refused despite having a space you should win your appeal.
