When can ICS be broken for adopted children

A slightly random question for a friend.

If you adopt a child who is due to start school in September 2016, but the adoption doesn't happen until after January 2016, does that child get any sort of right to breach ICS, or are they just likely to go to the top of the waiting list for places?

Full, but semi rural area, so there is only one truly local school.

Thank you for all your help. I'll be passing it all on. I will be offline for a few days now but wanted to make sure I had thanked everyone.

They will be so relieved that there does seem to be proper provision to enable their child to join her older sibling at school, even if the timings aren't perfect from an applications viewpoint.

The provisions were put in place specifically to address the issue of children in or leaving care who move during the school year. Without these provisions, they would often be unable to attend the best schools and be allocated a place at a an inadequate school or one miles away. Or both. Whilst this would be an issue for any child, for children with (statistically) the poorest educational outcomes, the impact is significant enough to warrant legislation.
