if eldest is right

another out catchment sibling been offered a place

not sure if true if won on appeal

they live slightly closer different county
we slight further and resident same county as school.

we both outside of apr area of prime responsability so our council gives no sibling link.

i know we are number 6 couple weeks back.

have no idea what other sibling is

or if anyoes dropped out.

due to it being ics appeal and no ones won appeal since 2001 and what others have said dident think error wa made i dident tick appeal bx just waitlist have I made a mistake?

is it to late appeal?

i dont think i can find ut who 5 are ahead of me so cant determine if this is unfair all i know is they distance away from the school.

It is never too late to appeal. Even though you have missed the deadline they must still hear your appeal. However, given that ICS rules apply, there are limited grounds on which this child could be offered a place (assuming your eldest is correct). Even if your eldest is right the fact that someone has been admitted is not of itself grounds for a successful appeal. You would need to show that your child should have been admitted rather than this child. If they were admitted via an appeal you definitely don't have a case. Given that you say the child who has been admitted lives closer than you they will almost certainly have priority over you, so I suspect they are one of the 5 who were ahead of you on the waiting list. The fact they live in a different county is not relevant. So I very much doubt that an appeal would be successful.

As the others have said, it's no problem to appeal. However, it's worth noting that you are very unlikely to get an appeal date before the end of term now - i believe the LEA have 40 school days to sort an appeal for reception - so realistically it won't be until end September. So you do need to have another plan for the start of school in Sept.
