Primary school in year appeal

Hello would anyone be able to help with working out some information I received from the school I'm appealing for.
I have been advised of numbers in each class from nursery to year 6. The school say their capacity is 210 however when I add up all the numbers of the actual pupils in each class the figure including nursery is 222 so I'm presuming they are already over their capacity. However when looking at performance tables for the school for september 2013 it states there are 230 on roll. Also looking at two previous ofsted reports the school numbers on roll in those years are are 225 and 226 respectively. Why is this? So confused. The published admission number for each year group is 30. Can anyone shed some light on the difference in all the figures. Thank you.

Does the number really include nursery? A PAN of 30 in each school year would be pretty standard and the school wouldn't normally have mixed age classes. And while a school can go over 30 in KS2, it shouldn't normally in yrs R-2. How many children are there in the year you want a place in?

There are 30 in the year im appealing for and the nursery is in the same building as the school. Some other years have vacancies and including the nursery there are a total of 18 vacancies, however not sure if the nursery has a PAN of 30 like other years do from reception to year 6. Also when looking at the school census details on the performance website it includes children aged 3 and 4 and when I total them all up it comes to 230

OK, the net capacity of the school has been agreed as 210, but this is for the facilities used by the school for the school years that are compulsory, that is reception (foundation 2) upwards. So whilst the nursery may well be in the same building they are not automatically counted as pupils.

What you need to do is add up the numbers in reception year upwards and see how that compares with the 210 net capacity. Because of the infant class size regs there should not be more than 30 in any class with one school teacher other than in some excepted circumstances.

The other thing you need to know is that the 210 net capacity is an agreed figure and is set up because of 7 classes of 30 pupils. There is in reality a maximum net capacity figure based on the size of the facilities available, a minimum figure, which is 90% of the maximum figure and then the agreed published net capacity which is usually somewhere between the minimum and the maximum.

Do not therefore believe that pupils cannot be admitted at appeal because you are over the next capacity, it depends on lots of other factors as well. The different numbers of pupils in the school illustrates to me that this is a school that does have some mobility in pupil numbers, this is not a problem it happens!

If you want to give me some specific figures on PM then I may be able to expand on what they mean.
