DC is in yr1 _27 in class . 8 year 1 are also in with another class. For various times during the day ,e.g P.E ,story ,start and end of day ,the 27 and 8 ,join up to make 35, with one teacher and class T.A .I thought it was 1-30 ,regardless of T.As. H ead says this i s ok as it is not all day . P lease can you advise and thankyou.

I'd be more interested in why the two groups are so unequally sized than the fact that they join every now and again.

The head it correct, I think, in the same way that it's ok to have an assembly without all the teachers there.

Providing that it is for things like PE and registration then it is perfectly acceptable for there to be 35 pupils together. However if that migrates into things like english or maths lessons with only school teacher present, then that would be breaking the infant class size regs. The number or lack of TAs is irrelevant in that situation, the regs are very clear that it is no more than 30 infant age pupils with one school teacher.

I would argue that it is easier for me as a teacher to teach 35 children in an English or Maths lesson than to safely teach 35 children PE.

You can have more than 30 in a class in infants. Infant class size regulations take into account ALL teachers in the school. This could include the Headteacher, non-teaching Deputy or SENCO. Having more than 30 in the classroom isn't an issue

The actual law states
"Limit on infant class sizes4.—(1) No infant class may contain more than 30 pupils while an ordinary teaching session is conducted by a single school teacher.
(2) Where an ordinary teaching session is conducted by more than one school teacher, the class may not contain more than 30 pupils for every one of those teachers."

HattyJack The 8yr1 are with reception and those year1 parents want them to feel part of the cohort .This is why this has been arranged . It all seems a bit chaotic to be honest.

As admissions says
"An ‘ordinary teaching session’ is defined by Section 4 of the School Standards and Framework Act 1998 and does not include a school assembly or other school activity usually conducted with large groups of pupils e.g. PE/games, music, singing, drama, watching television or listening to the radio." so the head is correct in saying it is acceptable to have more than 30 at these times

gosh I can see why the parents of those 8 children want them included with Yr1. I am not sure I would be happy if my Yr1 child was one of only 8 lumped in with Reception.
