Hi
I know this is in completely the wrong topic but I am having problems using the site.
Okay go easy on me as I have been very foolish.
I took my chances and sent a item via royal mail without tracking and a signature as I have done loads of times without any issue.
The latest item was expensive I know I know silly silly.
Anyway the buyer is claiming he hasnt had it and has filed a dispute and my paypal is in a negative balance basically I either pay money into my paypal account to the amount that i sold the item for or paypal will take the amount along with the purchase price of anything I buy.
The buyer I have found out is a business who buys many items of the same nature and he cant pinpoint if he has had his item off me not for definate but they are have told me they are giving me 2 days before they escalate the dispute.
I sent the item first class and have proof of posting.
Any advice on how to deal with this

You're almost stuffed. Learn from your mistake. Proof of posting is irrelevant, its proof of DELIVERY that protetcs you as a seller.

Private Message me and I will word a letter for you that you can email to them. They know exactly what they are doing, and I suspect you are a new seller, so they are probably out to rip you off, unaware that what they're actually doing is committing fraud and you do have some legal recourse.

Once they open a dispute, you will lose by default ,no matter what evidence you have, even if you had CCTV coverage of yourself posting the item at the post office counter, I'm afraid the smallprint in both eBay and Paypal T&Cs doesn't cover you unless you fit several criteria.

Ultimately, all new eBay sellers only learn the hard way.

I am so glad I read this! I am new to ebay and am selling some things at the moment and I never thought to make sure the stuff is signed for.

Sorry to hear that you are having issues, I can't offer advice as i'm an ebay novice, only sympathy. Hope you get it sorted.

Depending on the value of the item you can claim from Royal Mail using your proof of purchase.

Not many people know that all post is insured (up to a limit). It may help.

Details here.

Not necessarily. I sold an iphone for a friend which was sold as needing a new battery. The buyer took it to apple for a new battery and was then persuaded to part exchange it and buy a new phone. She then claimed that apple had confiscated it because it had a 'non-standard screen'. We asked for a copy of her paperwork which she emailed - that showed she had part exchanged it and ebay/paypal investigated fully - including ringing the apple store she'd been to and then found in my favour and refused to refund her.

But without proof of delivery you unfortunately don't have a leg to stand on.

I sent a parcel to a buyer's registered ebay address, have proof that it was delivered there but still had to refund the buyer because at the end of one of her very many emails she had given me an address (she just put 'my address is' no mention that her ebay registered address was out of date etc.) and claims the peple at her old address hadn't received it.
