On grounds that the LEA were 'unreasonable'.
YAY!!!!!!!!.
I can't believe it- it still hasn't sunk in.
Our darling little girl can now transfer to reception with the rest of her peers. It's been a difficult 8 weeks, but we have got there in the end

Im entirely new to mumsnet... But gladly came across this while searching sites for advice on school appeals. But I hav a hearing for my son's Infant Class size appeal for a VA school coming up and wondering if anyone could share some advise. My l'il man's been referring to this school as "my big school" for as long as he's had an awareness of going on to a big school. And it's hard coz the school is directly next to his current nursery though according to admissions it's treated as an entirely separate entity. It's just so hard to pin point facts and prooving the admission's authority was wrong... though I managed to dig out some numbers like 20:2 pupil teacher ratios, 4 out of 10 appeals won last year etc... But I was hoping more so to base my appeal on unreasonable grounds... Suggestions, experiences and advice all welcome and appreciated in advance.

KN, you should start a separate thread on this - there are lots of people on this site who may be able to help but they won't necessarily look on this thread.

Congratulations!! We will have an ICS appeal for DS2 who has not got a place at DS1's school (or any school for that matter), sometime before the end of August Confused but not been given a date yet. The waiting is driving me mad but in the meantime I'm trying to put together my arguments so I am prepared for anything they might ask. What sort of things did they ask you? What were your reasons for needing a place etc? Sorry for all the questions! Would be really grateful if you could PM me, or post details on here. :)

I am so pleased for you guys. I have just moved to bham and my daughter has been offered a place at one of our school choices ( she's in yr 5) but my son hadn't (he's in year 2) we have appealled but it hasnt been successful. We can re appeal in sept can you please give me any advice. My son is currently not in school and I am due to have my new baby on 15 August and I need to get him into the same school as my daughter in sept. I am really stressed. :((

We were successful in our ICS appeal a few weeks ago. Basically you need to highlight the error that has been made, so that if it hadn't been made, you would have been able to apply fairly to your choice of school and would have got a place. I don't believe many people win ICS appeals unless they can show that an error has been made either by the school or the council. I won't go through the details of our appeal but you are welcome to PM me if you want to know more.

Although it is possible to win an ICS appeal on the basis that the decision to refuse admission was unreasonable, it is very hard to do so. You have to show that the decision was one that no rational person would have made. It is very rare for an appeal to be won on this basis.

Most successful ICS appeals are won because the authority has administered the admission arrangements incorrectly and the child should have got a place. This covers mistakes such as putting a child in the wrong admissions category or calculating the home to school distance incorrectly.

It is also sometimes possible to win an ICS appeal because the admission arrangements break the Admissions Code and the child would have got a place if the arrangements had complied.

Each case is unique. Knowing how someone won their ICS case generally won't help you win yours.
