Hi everyone,

Need a little advice re appeal hearingr. My friend is appealing reception place - lodged by 16 may hearing is August 3 - over 40 days stipulated. Any grounds here or arguments against waiting so long? Croydon council.

If 16th May was the stated cutoff date for appeals to be lodged then the LA has 40 school days to hold the appeals.
I think taking a week out for Whit that this comes to the 17th or 18th July and the school term finishes on the 20th July, which would then be the 42nd day. After that none of the days count as they are not school days, which is somewhat cunning.
So it is marginally over the 40 days officially but actually more like 55 days, which is a long time.
Can you do anything?You can complain that this is an unacceptably long time but I suspect it will not get changed because they probably are full to busting on running appeals. My LA is currently running two or three appeal hearings at once but many LAs simply will not have that manpower in terms of clerks or independent panel members.
There are no grounds around this length of time which will change the odds of you getting a place at the appeal.

However why state appeals will be heard within 40 days if they arent!?
