I know they are only allowed 30 per class but are there any circumstances where they can go over?

For an excepted child (wins an is appeal)

Or

If they pay for an additional teacher and the is physically space in e classroom.

Not personally aware of other circumstances, but others may be.

If a child gets a statement and choosing that school means the numbers are
Over 30 that is allowed

There is a list of 'excepted' categories in the admissions code. It also includes children admitted with a statement naming the school, outside the admissions round, and those admitted under the fair access protocol because no other school has a place for them.

The list under the new code will also include twins and multiple births being kept together (ie where first twin gets the 30th place).

Apart from the exceptions on the list, the infant class size limit of 30 is strictly applied, to comply with the law.

Think we do need to point out that the limit is 30 pupils with one school teacher, there is actually no limit on the number of children in the class, it is the number of teachers that need to be with them that is the law. So 30 pupils = 1 school teacher, 31 pupils = 2 school teachers unless the 31st pupils is agreed to be an excepted pupil.

One of our local schools is having 61 in 2012 reception intake due to the 60th place being offered to a twin.
The policy is not to separate twins, so the 61st is the other twin.

Our school ran 3 classes of 33 last year, with extra teacher time to "compensate" for the additional numbers. In reality it meant the classes have 33 for 80% of the time and small groups for the other 20% (time in assembly, playtime etc is all together).

And if the LEA has made an error it has to insert a place for child, meaning they get extra place (but don't think extra teacher, not sure).
