Unsuccessful appeal... what next?

Hi. Our DD didn't get a place in any Primary school . So, we are going to appeal. What if unsuccessful? Should we go to court? If for example we win the court case will school give a place even they are overcrowded? Or we can ask compensation? Thanks

Your LA will eventually come up with a place for you although it is unlikely to be at one of your preferences. Keep chasing them until they do. Also make sure you are on as many waiting lists as possible.

If your appeal fails your can take it to the Local Government Ombudsman but they do not act as a second appeal. They will intervene if the appeal panel did not follow the correct procedure or made a decision that is clearly at odds with the facts. If the LGO finds in your favour they usually recommend a second appeal, but occasionally they will recommend that the child is admitted without any further appeals.

You can take the case to judicial review but I would not recommend it. It is expensive and if you lose you may have to pay the LA's costs.
