Anyone information on KS1 class size & what is permissible?

At our school y1 & y2 are in the same classroom totaling 30 pupils, the 'overflow' y2 were moved to the next classroom as I understand KS1 can only have upto 30 pupils to a teacher.

That said y2 pupils (overflow) have returned to the Y1/Y2 classroom to be given some lessons therefore exceeding 30 pupils. My question is is this breaking the law or is this ok to do for part of the day? We also have y2, y3, y4 all together in 1 classroom!

How many teachers teach the combined class?

It's 30 pupils per teacher, not per class, if I'm right.

Definitley 30 per teacher. You can have larger classes (physical space permitting) as long as you have an extra teacher.

We had a thread about this before.

maths was streamed and one stream had 37 kids. And I'm sure mrz said that it was legal.

Basically it comes down to what lessons and how many lessons are there more than 30 in the class. If for instance we are talking PE, then that would not be a problem, but if we were talking about the majority of lessons in the morning for english and maths having more than 30 then I would suggest that the current split is just to tick the box and the reality is something else.

One year, 2 of my kids happily trotted off to be registered with another class, then came back to me for the rest of the day.
Basically, it wasn't OK for my to have more than 30 on my register, but it was otherwise fine for me to teach 32 kids the rest of the time.

there can legally only be 30 at the beginning of the school year but that can go up in the year with no limit apart from space!

DCs primary had mixed year groups so that they could "flex" the number of children in a cohort to fit birth rates
it had to add up to 30 per class in total (at all times - we were not allowed extras in the year without LEA permission in case Ofsted came)

Any infant class that has a majority of Reception, Year 1 or Year 2 pupils must be limited to a maximum of 30 pupils to one qualified teacher in all ordinary teaching sessions.

Any infant class with more than 30 pupils must therefore have at least two FTE qualified teachers.
A teacher must have been awarded qualified teacher status; any other adult in the class cannot be considered as a teacher.
An ?ordinary teaching session? does not include a school assembly or other school activity usually conducted with large groups of pupils , and such activities should not be included in the class size count for School Census purposes

In extremely limited circumstances, an infant class may have more than 30 pupils.
Pupils may be admitted in unforeseen circumstances, e.g.
? Where a child moves into an area outside the normal admissions round and there is no other school within a reasonable distance (for advice contact PSU).
? Where a child receives a statement of special educational needs naming the school, outside the normal admissions round.
? Where an extra place has to be offered because an error has been made in the admissions process that leads to a pupil being refused a place incorrectly.
? Where an appeal panel decides that an admission authority has made an error which denied the child a place or has acted unreasonably in initially refusing to admit a pupil.

I have 40 in my class for the last lesson Mon-Thurs and Friday Morning
