We are moving out of the area in 2 weeks, my DS age 8 (yr 4) and age 11 (yr 6) will be moving schools. We will be a 2 minute walk from one primary but they only have a place for the yr 4 and a 10 min car journey from another primary school who only have a place for the yr 6. We have one car which will be used by me for work. I have applied to the LEA for places but ideally want them both in the same school as my partner cannot get DS 1 off to school and then DS 2 off to the other school. When speaking to the LEA I said I need them both in the same school as it is impossible for me to get them both to different schools in time, they as always were completely unhelpful and said if there is no place you have to look at the next school. My response was well one of them will stay at home until you can get them into a school together.
Has anyone else out there has similar problems as above and if so how did you resolve it.

Saying you will keep one of them at home until the LA can find a school that can take both of them won't work.

It is up to the LA to find places for your children but they do not have to be at the same school. They should be able to tell you if any of the schools have places in both Y4 and Y6. If they don't your children will be allocated places at different schools. You can appeal and try to get them both into the same school but there is no guarantee of success.

Can you get a childminder/friend etc to help? As prh says, the LEA is under no obligation to find places in the same school for you. Keeping a child at home will not work; you can't blackmail them. You can home educate should you wish, but that won't move you up any waiting lists. Appeal if you like, though if that is your only reason it's pretty weak unfortunately.

If you are going to choose one school I would be tempted to choose the school with a vacant yr4 slot. Being absolutely brutal you have more chance at appeal that a panel will allocate a year 6 place, given that they will only have two terms to go. No guarantee but more chance in my opinion

What you also need to be doing as a matter of urgency, if you have not already done so, is get your year 6 child down for secondary school places. It is likely that you are past the cut off date for applications but most LAs will accept a change of address for a short period after the cut off date.
