Didnt get 1st choice of school place, I've let my son down as I didn't bother to put a second choice :(

I am gutted, my DS didn't get my only choice of preferred school, his older brother goes to a different school but I didn't put that school as a preference as I didnt want him going there, instead he's been allocated a school that I would prefer him not to go to. At the moment we are going through the process of having an educational psychologist for him as there was concerns with his behaviour. Obviously I am going to appeal...my DS hates change and think this could be damaging to him, whether or not this could be the grounds for my appeal I dont know, any advice would be great, also I'm thinking if worst come to the worst could I get him into the school where his brother goes? i know I should have put this school down on the form and I'm really angry with myself for not doing so, hand on heart I didnt think I'd have a problem getting him in.

The first thing that you should do is ask the Local Authority admission office for a place at the school brother goes to and hope they are not full. If they are full ask to go on the waiting list. You also of course need to get son on the waiting list for your preferred school.
When it comes to appealing, the question is on what grounds are you going to appeal? You cannot realistically appeal on the grounds that your son is going to see an ed psychs as the LA will argue quite correctly that has no bearing on the school they attend. I would also say that there is little chance of success in terms of hating change, especially as there is good likelyhood that the appeal could be an infant class size appeal.
You can appeal on any grounds but your best bet is to appeal based on good reasons (and that is not it is a good school) why the school is the best school for your son. So consider distance to travel, what things the school is good at, what extra facilities the school has in terms of clubs etc
