losing school place?

What happens if the family gone away on holidays beoe receiving the letter with the school results and come bacj afyet the deadline to accept their place? Will they lose that place?

Not sure tbh. In these days of internet access can it be done online? Or can they designate a relative to answer for them?

They would have known the time frame when they applied. But if they applied online they can accept online from anywhere.

But yes, in theory they could lose the place, although in my experience ( not personal ) the council phone and check if people miss the acceptance deadline.

It depends on the wording in the booklet that the Local Authority sends out about admissions as this will state what they expect to happen. What they frequently say is that you might loose your place.
However what is most pertinent is paragraph 1.50 of the admissions code which says " If a parent has not responded to the offer of a place within a reasonable time, the admission authority must remind the parent of the need to respond within a further seven days and point out that the place may be withdrawn if they do not."
The use of the word must means that it is a legal requirement and the admission authority has to remind the parent in writing and give them another 7 days to reply. After that they will usually remove the place. However I do know of occaisons where the admission authority have not carried out the letter of the law and have removed the place prior to the reminder.

But if you know you are going to be away within that time frame you would phone the LA and explain wouldn't you?

I have just received my letter this morning and it states that if you are happy with the place offered you do not need to do anything and the school will be in touch shortly.

Other LEAs of course may be different.

my LA says you have to return the slip accepting the place by the beggining of next week and I know few families who are away and wont come back until May. I did not know about this before receving my letter so they probably dont know either

As Admission says, the LA has to send a reminder giving the parents a further 7 days to accept the offer. If they withdraw an offer without doing that an appeal should result in the offer being restored.

We got our place on 31st March and then a letter yesterday from school which we have to return by 06/05/11. I think it's pretty unlikely anybody would be away for that length of time.

The Surrey letters (which arrived today) say places must be accepted by 26th April so it's very likely there will be people who have gone away for the whole of the Easter holidays who miss the deadline - I don't think this deadline was well publicised before the letters went out.

gosh, that is a worry, didn't know about this. Luckily we are back home tomorrow having been away for 3 weeks.

Can I say again, if you fail to respond by the deadline set in the initial letter the LA MUST send a reminder giving you a further 7 days to accept the offer. If they withdraw an offer without doing that an appeal should result in the offer being restored.
