No, they absolutely cannot.

It does affect your right to statutory maternity pay though, I believe.

I started work when pregnant, although I didn't know because my period wasn't late until I'd been at work a couple of weeks (I blamed the stress of starting a new job). Needless to say I was very embarrassed about it but they were great. You will not be entitled to SMP but you will probably be entitled to Maternity Allowance so long as you meet a few conditions (worth looking into).

Thank you. I feel slightly relieved now. I wont be telling them for a while though as I feel terrible about it x

I got pregnant after 3 months in my new job. I went through my probation appraisal other 3 months later, kept quiet about pregnancy, and then told 1 month later (I was 4 months then). Needless to say, I felt terrible. Maybe the colleagues weren?t very happy, but they would not dare to say a discriminating word. It is now 1.5 years after I returned from maternity leave, and I am pregnant with the second! I comfort myself with the thought that after these 2 kids, I will not be having more and will work in this company for many years (happily ever after). Just relax, the nature is above us, and nobody will blame you neither sack.

I found out I was pregnant the week I started my new job after trying for 6 months to get into the industry!
They've been great about it so far (am 15 weeks+1day) and I am entitled to Maternity Allowance through the government so that will be useful.

I found out I was pregnant during an interview process for a new job. I was up front with them about it, and they offered me the job anyway, which was great, as they knew what they were getting.

Check out the u-gov site, but as long as you've worked something like 11 weeks of the previous year you're entitled to MA which is £120 a week, but you won't be entitled to SMP which is the 6 weeks at 90% of your salary deal.

I'm very lucky that I've had a very easy pregnancy (now 32+4) and am planning to work right up until my due day, so that I can get maximum time with LO after she arrives. It is going to mean I can only take 3 months mat leave, but hey ho..

babynelly2010 · 04/06/2010 12:20

I am kind of in similar situation. Do you have to tell them if you are in the interview process? We have not tell anyone yet, even our parents don't know.

merlin8878 · 04/06/2010 13:14

I was in the same situation a few years ago.

A month after I started my new job I discovered I was pg with DD2. I was a bit about telling work, but I had to tell them when I was 6 weeks as I had terrible morning sickness. They were ok about it.

I worked til 37ish weeks to get past April 1st that year as it was the year they increased SMP to 9 months.

I was still entitled to the full 9 months of SMP.

Check out your new works staff book as there should be some info in it as to whether you'll get SMP or MA. You should be able to get some info from the job centre too.

I'm there too... I found out during the interview process that I was just pregnant, phoned my union who said it was basically irrelevant because they can't base anything on it, and didn't say anything because like babynelly we haven't even told our families yet, so there was no way the first person I was announcing it to was a potential new boss! Plus I've had a previous mc so I was trying not to get my hopes up.

I figured had I not been watching for it (I tested the day I was due on) I could conceivably not know so early (I tell myself this to make myself feel better!)

Problem for me is, as a teacher this new job doesn't start until September, by which time I will (fingers crossed) be 22 weeks, so they're not actually getting me for very long. But I will go back to work, and this is a long term job for me, so I figure in the long run it'll be ok. And this baby is way more important than a job.

But I do feel terrible, and I'm dreading telling them! Good luck!

I am on maternity leave now. I was TTC and then got made redundant. DH agreed that we could take 6 months off (already have 2 DC) but of course as soon as we tried again I got pregnant, 4 months into new job.

I didn't tell them until 25 weeks (didn't have bad morning sickness), and I worked until 39 weeks (DS2 born 2 days after I stopped work) and I'll only be taking 5 months off.... also have agreed to do some ad-hoc work whilst on maternity leave (can do up to 10 days) - so all in all they are not too annoyed with me (they are pleased I am being so flexible and not taking the whole year off), but I still feel bad - even though I did 13 months work before I went to maternity leave.

Thank you all for your advice. Not sure whether I should tell them before I start so they don't think i'm hiding it from them.

babynelly the head hunter was the first person I told! My new boss new before my mum... We didn't tell most of our family until 17 weeks but all of these complete strangers knew - funny really.

But no - you don't have to tell them, i just felt I should - I didn't want to feel like I was lying to them, but it's up to you. Being pregnant should bare no relevance on whether they employ you or not.
