Hi,

Just a query really, our baby is 6 months and whilst we weren't really trying we've just found out we're pregnant, we've had previous losses before ds so trying not to get too ahead of ourselves however as I'm still on mat leave till end of Jan, was just wondering if anyone who works in NHS could help. As I work within the NHS, by the looks of it baby would be roughly due mid June next year would I still qualify for my maternity pay, I don't get enhancements anyway as my job is mon-fri. My mat leave technically ends in December but I've taken a month leave if this makes any difference. I've just found myself worrying that I may not qualify as I'll only be back 4 months before I go off again?

Hi OP

Your second maternity leave pay will be based on your average earnings between weeks 16-25 I believe. So if you are back at work (including annual leave) during this time, you should be fine x

Yes this.

Also, you're pregnant. Your male partner is not. There is no such thing as we're pregnant.

Just to be aware, different trusts base maternity pay on different time periods so make sure to read your trusts maternity policy to find out when your qualifying period for pay is.

Payroll should calculate your next mat pay based on full pay if you are in a period of lower pay due to SMP/ AL etc.

I returned to work at 26 weeks and initially they did mess up my next lot of mat pay however I queried it stating the T&C written in the NHS employment handbook (link
abive) and they recalculated based on “notional full pay” and back paid me what was owed.
