SMP can anyone offer advice please!!!!!!

My partner has just been offered an excellent job up country, and obviously i would go with him.
However if i go would i have to give up my maternity pay as i would have no intention of returning to my old job? Only been on maternity leave for 2 months so far. Just even with the excellent job offer we still couldn't afford to lose the income?

wait for the experts but I am sure maternity pay is an entitlement and not dependent on you going back to work.

It depends on what you are receiving. If its just SMP then you're fine. If your employer is paying you extra, then you may need to pay it back, depending on what is your contract

If its smp only then you won't have to pay it back and will get it for the full nine months even if you move. if its enhanced then it depends on the company policy. you won't have to pay back the statutory element though even if you have to repay some or all of the enhanced element

I don't have any of it enhanced, just straight SMP!
But should i tell them when i relocate or just hand my notice in at end of nine months?

I'm worried even to call them and inquire as they're the type of company that if they can stich you up they will!

If you're just receiving SMP, then just tell them at the end of the 9 months if they're awful

Thats what my mum said to do, but i would worry about a someone finding out and dropping me in it!

Although i'm not close to collgues they have been keeping in touch etc with baby all very intrested and if i just disappear someone's bound to notice!

miss vicki - you are ENTITLED to the smp, even if work find out before hand they can't do anything. Just fuck em off

To be honest if you are only getting SMP then you might as well tell them now, you won't lose anything and if colleagues have been nice enough to be interested in the baby its a bit rude to just disapear.

Your service pre Pregnancy is the important thing - if you are entitled to SMP you keep that right even if you have no intention of returning to work.

You should resign with your normal notice period. e.g if it is 1 month in your Handbook write to them one month before. You could always resign in advance and state in your letter that you are giving additional notice but tbh I would not worry too much about that.

Just to stop you feeling too guilty... employers don't actually fund your SMP. Small employers (paying less than £20k per annum in NI to HM Revenue & Customs) get 100% of the money back plus approx 7% on top for compensation. Larger employers get at least 80% of the SMP back from HMRC. So no need to worry. Just hand your notice in 1 month before your due to finish your leave.

They cannot stop your SMP. Won't you need to tell them your change of address so you still receive your payslip when you move?

SMP is non-recoverable. any additional benefits are if you dont keep to the terms agreed.
