Hiya really worrying can anybody help with this.

I work part time for nhs. Used to be full time. In the same job for 14 years last 4 years have been part time. I have just read online I won't be entitled to stat pay as I don't earn enough to pay national insurance. Does anybody know how this work and if i will be entitled to stat pay full nhs maternity?

Would be so grateful of any helps.

How much do you earn? You need to earn at least £123 a week to be eligible for statutory pay. Enhanced NHS maternity pay may have different rules though, so you may be eligible for that even if you’re not eligible for statutory pay.

Yes I earn over £123 a week. I earn £925 a month. I have only just realised though I no longer pay national insurance and I don't know why. Tbh I never look at my wage slip as its the same every month. The government wwebsire doesn't state I must pay NI but something I read online on a random policy handbook said I must so it's worrying me a bit. Plus I'd like to pay NI for future pension. Thank you

is this your first child? If you claim child benefit you get NI credits which count towards your pension until the child is a certain age (12 maybe). So if you already have a child and claim CB you should already be getting the credits. If not, from when this child is born you will get the credits as long as you register for CB.

Sorry ignore me. NI threshold has gone up more than I thought so no you don’t pay it any more. The threadhold will have increased at some point meaning your wage then fell underneath that point so you stopped paying.

the bit about CB is correct though.

At £925 per month, you won’t pay nic but you will be earning “credits” for state benefits like pension as you’re earning between the two lower nic limits. It’s all done via the paye system for workers just like it’s done via the benefits system for carers, unemployed etc.

Ahh thank you all so much for your help about credits by PAYE and CB for pension. Fingers crossed I am entitled stat maternity pay as well as My nhs maternity to cover the last 13 weeks. Thank you all

I don’t work for the nhs, but I do work part time and earn just over £900pm, without paying NI.
I am entitled to stat maternity pay so I presume you would be too 👍🏻

Thank you everyone @Starbiscuit that's brilliant thanks. I read that if you earn above £124 but less then the cut of of about £1200 you are still classed as paying national insurance but without actually making payments. This must be the category we fall in. I had no idea I had even stopped paying them lol. Thank you

I can’t get statutory maternity pay due to this and as I don’t pay NI I won’t get the maternity allowance? Is this true ? :( my second child

You don’t average it over the year it is the earnings from
that 8 week period that counts. How many weeks pregnant are you?

Thank you yes the 8 weeks it’s asking me for will be 18 January to 15 march … I don’t take home £492 a month as they take out pension but that’s how much I get paid top line but that over 8 week period is less than the £123 weekly allowance

The wages you get paid in weeks 17-25 of pregnancy is what gives the figures for SMP. If you get less than £123 as an average across those weeks then you won't qualify for SMP but could get Maternity Allowance instead. NI credits are only taken into account for MA if you are self employed.

Thank you @dementedpixie yeah it is less I think as it is monthly . Are you sure about the MA the national insurance only counts if self employed? I’ve been reading if don’t pay NI you only get £27 a week!

The £27 is under the Self Employed heading
You will be entitled to 90% of your average weekly earnings in weeks 17- 25 (or last 2 payslips prior to week 25 if monthly paid i think)

Thank you so much I hope that’s true. I can see what you mean there now about under the self employed bit. I have been so stressed. And so annoying miss out by I think like £9 to get SP x

From reading the Maternity allowance info you need to provide payslips for 13 weeks or 4 months (if monthly paid) where you were paid more than £30 in each week. Choose payslips where you earned the most money. You also need an SMP1 form from your employer saying you don't qualify for SMP.

Is there any way you could do overtime to increase your salary in weeks 17-25 so you can qualify for SMP or would your employer not allow that?

Thank you yes I can do that, I will send them. . Yes I’m waiting for my meeting in march for her to confirm I am not entitled to the SP and will ask for the SMP1 form.
unfortunately can’t do overtime as believe it or not I clean a doctors surgery and it had been flooded so we have more cleaners than rooms at the moment so any chance for over time is gone as not covering days or holidays etc

Have you done any self employed work during this pregnancy? You only need 26 week before due date and actual earnings don’t matter if you choose to pay NI contributions of approx £45.

She doesn't need to pay any NI contributions if she has been employed.
