Hello,

I have a 13 month old little one and have just found out we're expecting again, due in Dec. My maternity leave ended in Feb but I couldn't go back as I'm currently struggling mentally. I'm still off sick at the moment and wasn't planning on going back for a good few months. I'm just worried about if I'll be entitled to any maternity pay when I go on leave again if I don't go back and stay signed off? I do have all of my annual leave to use for this year so could I just use all of my annual leave in between now and starting maternity? Any advice much appreciated as I've no idea what to do for the best!

If you’ve been off sick since Feb have you been referred to occ health yet?

Hello OP, I just want to say that I don't think it's correct that your mat pay entitlement is strictly calculated on the pay between weeks 17-25. If you have a look on the gov website for the advice for employers, if you're paid monthly the pay period is basically the two full months' pay packets before week 25. That may not be strictly weeks 17-25 depending on when in the month you get paid. Those exact weeks only apply to people who are paid weekly. If you're paid monthly it's based on your monthly pay in two full month pay periods prior to the qualifying week (week 25). So it could start a little earlier than week 17 depending on what date you normally get paid. (If you get paid weekly then ignore this.)

Thank you I didn't know that! It's all a bit confusing isn't it! I'll get some more advice in the mean time, I'm only 5 weeks so plenty of time to sort everything out. Thanks for your reply :) x

Depends on frequency of pay but given the OP is trying to have the penny and the bun (as it were) that’s not really the major consideration.
