we are a same sex couple expanding our family through surrogacy (another person is carrying the baby).

my partner has been offered a better job that she wants to take. However legally speaking we don’t want to lose the right to share parental leave and we have no idea how this works.
A few questions:

1- is it worth sharing upon job offer im the next week or so what we are going through? It’s been less than a month from transfer so anything can happen and we don’t want to overshare.

2- we’ll need some flexibility to fly to another country for the baby. How would you approach this with her employer? I don’t think they can say no to be there for the birth.

3- my partner is intending to take 3 months and I’d take the rest. Maybe this is not so bad for the new employee after all?

4- anything I should think of and am not?

All of this will depend on their policy - they should have one, I think surrogacy would usually be included under the adoption terms. You could contact their HR department and request their maternity/paternity policy and avoid disclosing in full to your new employer (assuming it's a big enough company they have a department)!

Changing jobs at this point could invalidate eligibility for any paid leave - many companies require a certain length of employment before going off. I think it could also invalidate entiltlement to shared parental leave - there will be details on the government website.

Personally I wouldn't disclose this early. It's pretty standard for staff not to disclose until they are 12 weeks ish, but if you feel comfortable doing so then of course do.
