Share Parental leave

Hi - Could someone explain how shared parental leave works?
My work provides 26 weeks of full pay (and the rest of statutory pay) . My partner's provide 20 weeks of full pay.

we would like to take as much as possible on full pay. Does the above mean that I can take 26 weeks (then go back to work) and then he can take 20 weeks (and then go back to work)?

You'd have to check the individual policies. His employer may deduct any paid maternity leave you take from what they offer him and then he may just get statutory. Or they may specify his fully paid period is at the start in which case you could be off at the same time rather than at different times.

Whatever you choose to do, you need to cut your maternity pay/leave period in order to free up pay/leave for him to take. This means you can share up to 50 weeks of leave and 37 weeks of pay. (Need to take 2 weeks off by law)

Check with the HRs at your company.

We did shared leave and between us got 11 months full pay. However my company required everyone (men and women) to take the first six months. My partners company gave full pay for five months taken at any point in the year.

Any enhancement on SMP will be really dependant on your company policies.

we are doing it and I get 4 months full pay, husbands company does 6 months full pay, but:

  1. if we are off at the same time then the SMP portion would be deducted off husbands pay.
  2. if he takes over at 4 months then he then only gets 2 months full pay (because the 6 month clock starts on the baby’s birth date).
  3. he still gets 1 month paternity leave on full pay regardless of which part of maternity leave we choose to share.

this seems quite different to some other accounts I’ve read.

We are doing SPL, DH works for the NHS, I only get statutory so I’m taking first 6 months, 3 months paid, 3 months unpaid and DH is taking 6 months afterwards all paid at occupational pay. The NHS will only pay enhanced pay if you are entitled to statutory which is why I’ve transferred 3 paid months to him.
As PP said, every policy is different!
