My due date is 10/11/23.
On 19/09/23 the company I worked for was bought by a new company, with this looming I had previously emailed the new company asking questions regarding my maternity pay. I asked them would my enhanced maternity pay of 13 weeks full pay and then statutory still stand? Also that my holiday that I had saved be paid at full. So holiday 19th October-5th November and mat leave starting 6th November. They responded saying yes to both questions and to please forward mat b1 form etc.
since then I have emailed at minimum twice weekly, to ask if this has been processed and added to the system, I have had no response. I have emailed asking who would be completing my pregnancy risk assessment, no response.

I have received one pay from them, which has been wrong, they responded to this email and said it would be rectified.
I have emailed HR, operations and the owner. I have said if I get no response soon, I will have no choice but to speak to ACAS. No response, what shall I do?

Do you know if the company plans to move your employment to the new company under TUPE? If you are transferred under TUPE I understand you cannot be moved to a lesser package, you should move with no changes to your contractual terms,

If they've confirmed you're getting what you expect, what are you now emailing for? Reassurance that it's been put in motion?

You seem to be badgering them but I'm not sure why? They're rectifying the mistake on pay which I don't see as a big deal since they've just taken over.

The maternity pay thing does take time.

I also don't understand what they're doing wrong? You asked them something, they said yes. So why do you keep emailing them?

I wonder if they employ the same system I do, completely different industry, when dealing with clients. Everyone in the class gets the exact same amount of time spent on them by me. If they want to waste their time asking the same question I've already answered over and over, that's their time gone.

But they’ve answered you. They said yea, it’s all in hand and they’ll be in the process of dealing with the takeover and sorting out everyone’s pay and all the rest of it. Your maternity has already been confirmed and will be in their hands. If there are any issues with pay then you can sort it out if it happens, but it sounds like they already looked into it and have it set up for you.

Apologies I missed out that since then the operations manager rang me to say I have not accrued enough holiday with them to take the time off paid, due to only working with them a short period and also they way the bought the company as part of a shared deal system, so does not attract tupe regulations. So the reason I have been emailing them is to get clarification on despite them saying I don't have enough holiday with them, does the prior agreement still stand. Should I now hang fire until my next payday? To see if they pay me correctly. I cannot name companies, but this company has many many tribunals against them and are known for not paying. I understand that it may seem like I'm badgering them, I just wanted an email saying prior agreement still stands and you will be paid accordingly. I have my C-section on 7th and I don't want to be worrying on 15th that I haven't been paid correctly.

Re the holiday, when did you join them, what is your holiday year and how much holiday do you get per year?

It is also possible that the maternity pay is affected as often enhanced pay is a benefit, not a right. Has your employment actually transferred to the new owner, or is it simply that your employer’s owner has changed?

I would call ACAS for advice. No need to go in all guns blazing, just have an initial chat.

Hi,
This is where it gets tricky.
My old companies holiday ran, 1st April-31st March. So whilst I hadn't accrued the whole holiday year yet, they encouraged you to use it as you most likely would not be back before the holiday year end. Maternity enhanced pay I had been with the old company long enough and had received a letter of payment breakdown weekly by week.
We are now officially owned by new company, there holiday runs 1st Jan-31st December and they only offer statutory maternity pay from what I have seen in their employee handbook.
I have not received a new contract or had any consultation periods for changes.
This is why emailed for clarification before the takeover, as I knew it would get complicated .
