So I'm currently employed but of sick leave until may by may I will be ready to start mat pay, my issue is I just moved out of area from my job (several hours) can I still claim SMP from the employer or because I've moved will I only be able to get gov mat pay???

I've literally yesterday just moved, I'm currently still employed just on sick leave due to pregnancy illness

I'm not understanding how the two things are connected. If you'll go straight from being on sick leave to being on mat leave, then you'll continue to be employed, so would be entitled to SMP through your employer.

If you are employed by your employer then yes you get SMP through them. Be warned that if they offer above SMP you may have to pay it back if you don't go back.

If you're not employed by them but you qualify for SMP then no you don't get it through them, you apply direct to HMRC I think.

Yes this is what I mean I won't be returning to work as I don't live there anymore, should I be telling my employer this and will that make me no longer eligible for SMP?? But I am currently employed as my workplace do not yet know I've moved away.

No. Don't tell work until the very last moment of your maternity leave. You earn holiday pay while on sick and maternity leave. They will pay you that as a lump sum when you leave.

If you're only getting SMP you won't need to pay anything back.

If your company enhances your pay they may ask you to pay that back, but they have to have it in your handbook / have already told you.

Personally, it's what I'd do. There are plenty of women who choose not to go back to the same employer after mat leave, but there's no requirement to declare your intentions in advance and as a PP pointed out, while you're still employed by the same company you'll also be accruing holiday pay.

Once you qualify for statutory maternity pay you would still get the money even if you leave. You need to still be employed at week 25 to qualify. How pregnant are you?

And if you are off with a pregnancy related illness in the 4 weeks before your due date then your employer can start your maternity leave at that point
