Hi,

I have just found out I'm pregnant.
I've worked for the NHS for 11 years but had a break in service for just under three months as i decided to locum. I then returned as a permanent NHS staff member.

Looking at the policy it says that employees have to have 12 months continuous service to have NHS maternity Pay by the 11th week baby is born.

However I'm sure I read somewhere else that if you have a break of up to three months then it doesn't go against continuous NHS service. Can anyone shed some light on this?

When did you return from break in service? It says on the NHSBSA website that it's 3 months break in service, no mention of how many weeks.

Also it's 11 weeks before baby is due. Not sure if you meant this by 11th week baby is born

As in a break of three months. I will have had the baby before the 11 weeks if that makes sense.

Also I left on the 8th of April but returned on 5th July. So literally almost 3 months. HR havent got back to me

Does the policy not state what is meant by continuous service? I will check mine tomorrow and post back but it may be different per each trust?

Who are you contacting in HR? Just a generic email address or a named person? You could try payroll too.

Just found this online

To be eligible for NHS maternity pay, you must have 1 year of continuous employment with the NHS (not necessarily the same trust), without a break of more than 3 months, by the time of 11 weeks before your expected week of childbirth.

I know our trust has started to discount short breaks in service to try and encourage staff to come back so definitely worth discussing with your manager/HR x

They have just been a bit unhelpful and I'm being passed from pillar to post at the moment.
My break in service is literally just under three months so would I qualify for OMP?

Your break was less than three months, so you should qualify for maternity leave as if you didn't have the time out of service. If you are part of a union like the BMA, I recommend asking them or looking on their website. Or you could contact pregnantthenscrewed.

If your break was under 3 months then you’re fine
