what happens if you give birth during your pre-maternity leave Annual leave?

I am taking about a month's annual leave before i start my maternity leave at week 38. I have now been diagnosed with gestational diabetes so more likely to have baby a bit earlier than 38 weeks. If that happens does my maternity leave start then? if so what happens to my annual leave?

This happened to me. Mat leave was supposed to start on due date, with annual leave being taken from 36+5. Instead mat leave started at 36+1 after I was admitted to hospital and had baby at 37+1. Once you're signed off sick with a pregnancy related illness after 36 weeks, or baby makes an appearance, your maternity leave starts immediately.

In my case the annual leave I didn't get to take was carried over to next year's annual leave allocation, and tacked onto the end of maternity leave. While it meant I didn't get much of a rest pre-baby, it did mean I got to go back on the original agreed start date, and I got a bit extra money right at the end.

What does your policy say? Maternity leave starts as delivered and holiday is rolled over.. Can tag on end or use in holiday period when come back...

Your mat leave starts when the baby is born. I tagged my leave on the end then instead of the start.

I've not gone through this,but I asked and its as above.

So say I finish working at 36 weeks, but intend to start ML at 40 weeks. If I were to give birth at 38 weeks, I'd start ML the next full working day, but the 2 weeks of AL I didn't take would be 'returned' and I could use it before coming back to work.

This happened with my first. Annual leave until 38 weeks but gave birth 36+6.

Maternity leave started straight away and they rolled the “lost” days leave onto the next years allowance. Best checking your maternity policy though 😊

I hadn't even finished work when my baby was born, was supposed to have another week of work and then a week or 2 annual leave. My maternity leave started the day after birth and then the left over annual leave was added to the end of my maternity leave.

I didnt even get to my pre maternity leave Annual leave! I had it at the other end of maternity leave which meant I could return to work officially when DD was ten months and was back on full pay from then which really helped. Im pretty sure it isn't legal to deny you the leave to carry forward.

I took 2 weeks leave then started my maternity 2 weeks before my due date my dd arrived 3 weeks early. I started my maternity immediately and the week of annual leave was tagged on the end of maternity.

I planned to have two weeks leave, then start my maternity leave at 38 weeks. Baby arrived at 35+4. My maternity leave started immediately and my annual leave was rolled over. It meant I had over 50 days annual leave to use in 5 months as they wouldn't let me carry it over twice. So I moved my return date back by a month, then took it as leave, so I had an extra month of paid annual leave before I went back, which was handy as I then had less time unpaid and I worked 4 days a week to use up the rest of it before our annual leave year ran out

Mat leave starts from the day your baby is born, in terms of your annual leave it much depends on your organisations policy in terms of leave. For example we are allowed to carry 40 hours over to the next financial year, extra in exceptional circs. Ours would probably just get carried over and I would have asked to latch it onto the end of my mat leave

Legally your maternity leave will start as soon as soon as baby is born however my employers last time didn't tell our accountants I gave birth early so mine started as originally planned. I didn't ask them to, in all honesty it was probably laziness on their part.
