Hi,

Im due annual leave as from Thursday for nearly a week then i officially start maternity leave.

Currently i am 33+6 and i am in hospital having just been diagnosed with mild pre-eclampsia. I am due back to work on Monday.
As it is only mild, they are looking to send me home and monitor me throughout the weeks.
I dont think i should go back to work next week, i get easily wound up and i know my BP will rise.
So, my intention is to call in sick next week then stick to my original plan of holiday then maternity however, my boss is a bit of a dimwit and will try to move all my holiday and maternity forward instead of me using sick.
I am right aren't i to presume that as i am less than 36 weeks, he cant force me to go on maternity or move my holiday and will have to allow the sick days??

They can only force you to go on mat leave from the 4 weeks before your due or if the baby is born. These are 2 sources on that. You can self certify for a week so yeah just call in sick untill Thursday and dont let your boss mess you around.

Also heres the rules around sick leave and they cant make you take holidays if your sick.

@Frustration21 yes you're right. The gov.uk website says maternity leave starts automatically if you’re off work for a pregnancy-related illness in the 4 weeks before the week (Sunday to Saturday) that your baby is due. As long as that's not the case, they can't force you to change your plans. www.gov.uk/maternity-pay-leave/leave

I messaged my manager and made it clear of my intentions and he seemed to accept i will be taking the first week off sick
