Got the job without telling employer I am pregnant

Hi ladies!
So I'm looking for advice desperately.
I'm currently 37 weeks pregnant and 3 weeks ago,I had an interview for a zero hour contract admin job. They asked if I was able to start work full time immediately and I said "I am able to work full time for now".
They couldn't see that i was heavily pregnant as the interview was done online.
I wasnt expecting to get the job,so naturally I was thrilled when I found out that I got it.
Now my line manager is asking if I am available to work next week but I will be on maternity leave from next week.
How do I tell her that as much as i would love to start working for her i cant otherwise i would lose all my SMP? But i would definitely want to start working as soon as my maternity finishes.

I was hoping that I could do part time voluntary work rather than paid work?

@Emma70459

This thread isnt about my entitlement to SMP. Its about how I break my pregnancy news to my employer who I havent started working for
You email them now with the happy news and wait for their reply. They can't withdraw the offer legally. So you're fine. hth.
savethewales · 25/11/2020 19:30
@savethewales agreed. Just making sure we weren't giving out incorrect information
At no point was wrong information given. I wouldn’t be surprised if the OP is stating SMP not realising her employer offers x amount topped up; given she’s saying she can start a new job at 37 weeks pregnant.
OP no-one really cares about your entitlement to SMP, it’s to warn you about starting a new job and not returning to your original employer if you haven’t checked that first.

Most organisations complete a cull of workers on the Bank who have not completed at least one shift in a three-month period. You will likely be removed from the Bank and have to reapply in the future. And workers do not have employment rights

Take the advice you give your toddler: Use your words.

Emma70459 · 25/11/2020 19:32

So bank workers are not allowed time off after giving birth?

OP posts:
Emma70459 · 25/11/2020 19:33

Its SMP, I'm dont need to give a penny back to my other employer if I'm not going back there after maternity

When do you want to start working again after you've had your baby?

With 3 under 3? How?

If you’re sure that’s all it is then your grand.
Frieswithanythin · 25/11/2020 19:35

I don’t believe this thread. It’s made up

CandyLeBonBon · 25/11/2020 19:35

Sorry @savethewales I wasn't implying you were. Apologies if I gave that impression. I was just making sure I was singing from the same hymn sheet.

PanamaPattie · 25/11/2020 19:36

Tell your new employer your news. See what happens. Good luck.

CommanderBurnham · 25/11/2020 19:39

Is it test and trace type? If not don't worry. Just leave yourself in the bank and see what happens. The only advantage of zero hours is that either party can say no to work. Just say no when asked. If they ask why, just say that you're pregnant but that you had disclosed it at application.

llm24 · 25/11/2020 19:39

I don’t understand why you would go for the interview knowing you could give birth any day now

Yep the employer should have double checked all your details but I think you have put them in a very awkward position

Someone who needs and can do the job right away is out there your not playing fair

Ronia · 25/11/2020 19:41

Leaving aside the pregnancy issue, as I understand it you're currently employed. I assume this job has a notice period so when asked if you were available to work full time and you said you were, was that true?
In terms of doing paid or unpaid work for.yhis new company, if you're employed by someone else (and you're getting SMP on that basis) you may be on dodgy ground working for someone else?

Catlover77 · 25/11/2020 19:41

@Emma70459

So bank workers are not allowed time off after giving birth?
They are under no obligation to give a bank worker any shifts - you need to be mindful that you have no employment rights. Maybe stay with your current employer
Posturesorposes · 25/11/2020 19:42

The OPs posting history suggests she is in serious trouble OR there is an intention behind such threads.

Gncq · 25/11/2020 19:43

Ok, do you need to contact the HR employee who gave you the job.
Tell them

"Sorry I didn't mention it during the interview, but I am due to give birth in a week, can I do unpaid voluntary work in your offices as and when I feel like it to boost my CV instead please?"

They'll rightly tell you to F off.

SoupDragon · 25/11/2020 19:43

Surely you don't have to break the news, just refer them to the health questionnaire you filled in.

tomatoesandstew · 25/11/2020 19:43

This post goes to show how many backward views there are from women about other pregnant women. They can't discriminate against your pregnancy status and for a zero hour contract there's no reason why you couldn't pick them up when you finish mat leave. Banks make big profits. They can't privatise the profits and socialise the risks.

Ilikewinter · 25/11/2020 19:43

Oh wow OP youve really stiched them up. I wouldnt expect any hours off this company as youve clearly wasted their time recruiting you.

tsmainsqueeze · 25/11/2020 19:45

Unpaid work on a part time basis ?? i don't think you can ask /expect this.
At my place of work what you have done would cause big issues for my team , we would all have to cover the work you would have been doing had you have started the job in the normal way .
I think you should tell the truth and turn the job down .
I also agree with others saying this type of thing tars all women / maternity leave with the same brush .

RunningFromInsanity · 25/11/2020 19:47

OP just read your other threads, you are going to have a newborn plus two toddlers, you won’t have time to work, paid or otherwise.
You need to focus on claiming the correct amount of benefits and CM from your ex to help you through your maternity leave.

Email this company, tell them you are starting maternity leave now and can start again on X date and you will make contact nearer the time to get the ball rolling.

CandyLeBonBon · 25/11/2020 19:52

@Emma70459

So bank workers are not allowed time off after giving birth?
Well it's a zero hours contract op. The clue is in the name. You have some statutory protection, provided you start your job and sign your contract before you give birth. You do need to tell them you are pregnant but they are not allowed to withdraw a previous offer. You won't be entitled to smp from this employer (and you state you'll be getting smp from your other job). You may be entitled to maternity allowance and provided you are in an employed contract before you give birth, you have some statutory rights. That's based on googling citizens advice etc and I'm sure an HR pro would offer a much better range of advice.
