Hi Guys,

So I was unaware I am legally entitled to paid time off for appointments and have used flexi for my booking appointment and call and then used a day of AL for my 12 weeks scan.

I am going to bring it up with my manager today but what are the chances of me even getting
1/2 a day of AL back? I am going to insist
on getting the flexi time back as I was working before and after both appointments but I feel like it’s a grey area for my scan. I think it’s unfair as I never would have taken a day if I knew I was entitled to it off paid but at the same time I took a day when I was there for only half a day.

Did your employer know you were pregnant and that you were taking AL and flexi time for antenatal appts?

If the company didn't know I would probably leave it as it was your mistake to book AL and flexi time when you could have legally taken the time off for antenatal appts. In the nicest way possible, there is so much information available for every facet of being pregnant, it seems surprising you didnt know or hadnt thought to check.

If they did know you were pregnant and also that you were using flexi and AL to cover the appts, I'm not sure where you stand - ie legally if the onus is on them to tell you or for you to know this for yourself.
I would probably try and find this out first before 'insisting' I get any time back.

You are legally entitled but obviously they cant give it to you if they dont know why you asked for the leave. I'm sure if you take the appointment letter with you and explain they could give you the leave back.

They presumably didn't know you were pregnant when signing off your annual leave? - to be honest I think it's a bit cheeky to now ask for 1/2 a day back? My 12 week appointment was a couple of hours tops. Certainly not 1/2 a day

I've always taken the day as annual leave as didn't want employer to know in case it was bad news (it was once so I was glad I was under no pressure to go back to work)

Nope my manager was fully aware and I provided copies of my appointment letters she was the one who told me I had to use my time for the appointments and I assumed this was correct had no reason to believe otherwise

My 12 weeks was at 9:30 and I didn’t leave the hospital until 12:45 they couldn’t measure baby properly because of her position they had me walk around do a few simple exercises and drink more water in between other scans.

I did this first pregnancy...line management knew my time off was for appointments and claimed to have "checked" with HR so I didn't think to follow it up myself (naive first timer!). They gave me all my time back - both flexi and AL.

I'd definitely ask for it back and flag to HR that your manager was aware and told you that you'd need to take flexi time or annual leave as that could get them in a lot of trouble legally so they'll want to talk to her. Not sure how you'd take flexi time back though, did you just move your hours around? Like start late and then work late etc.? On the time taken as annual leave I'd 100% expect that back, your employer should know their legal responsibilities and as they gave incorrect information should be fixing their mistake.
