Hi Ladies.

Need abit of help.. my employer sent me the maternity allowance link to direct gov to fill in to claim for maternity pay.. however I'm 21 weeks and I'm sure this can't be filled in until 26 weeks or 14 weeks before your expected due date. I've tried searching online but nothing's that clear. Im still waiting on my 25 week midwife appointment to get my mat1 form. Unfortunately I'm the first pregnant employee for the company so they are also abit clueless like myself. Any help would be much appreciated!

Will you not qualify for Statutory Maternity Pay?
Maternity Allowance can be claimed from 26 weeks

You qualify for SMP if:

  • earn on average at least £120 a week
  • give thecorrect notice
  • giveproof you’re pregnant
  • have worked for your employercontinuouslyfor at least 26 weeks continuing into the ‘qualifying week’ - the 15th week before the expected week of childbirth

@dementedpixie well this is another issue I have come across while searching online.. they are two different things which I didnt know. I've worked for my employer for over 3 years and they have said I'm entitled to the 90% for 6 weeks them on for statutory. So would this be claimed from 26 weeks of pregnancy too? I'm going to email HR now to confirm 😀

You qualify for SMP then, not MA and its them that do the paperwork, not you

The earliest you can start SMP/maternity leave would be 29 weeks but you dont have to start it as early as that.

Maybe they should read this link as it's the employers guide. You shouldn't have to be researching this, its their job to sort it out

Thank you so much for your help. I've emailed and they have replied saying they don't know either so they will look in to it... I have just sent them the link to what you have sent me... hopefully that's helps them.. I did think I wasn't supposed to be filling in this form. Xx

That's all you should have to do it get a MAT B1 form from your midwife after 22 weeks.
