MatB1 - difficult midwife withholding

Hi all.

My midwife seems to have taken a personal dislike to me (as they can do if you disagree on anything) and is using my MatB1 as some sort of punishment.

She's refusing to confirm that she will provide this at out next appt (I'll be 26 weeks) and creating imaginary problems like saying my surgery have my old name on their system so she can't do this in my legal name (my name in my passport that the tax office has). I've checked and my surgery 100% have my new name following receipt of my deed poll and new passport.

What's more I've now changed addresses and doctors and registered with my new name and address and asked her if she can confirm this can now be provided and she will not confirm either way.

She sends childish texts and makes me feel really uncomfortable. I've explained to her she can't withold this or refuse to accept my legal name (she threatened to change it back on their system due to the apparent GP surgery error) which is completely fraudulent.

I feel like I need to say and do all the right things to get this golden certificate but I really want to complain and change care provider without this affecting the time constraints of getting my matb1

I asked my gp surgery if they can provide this and they said it isn't something they do.

Is there any other way I can obtain this doc?

I would complain and ask for a different midwife. She’s batshit and you don’t need the stress.

Yeah bin her off, get a new midwife and make a complaint about her. Hope you’ve kept the texts?!

Is she part of a team that you can get hold of? I was told I’d get mine at the next appointment after my 20 week scan (this seems common practice on the whole). This was 28 weeks for me (2nd baby) & too late for work. So I just rang the midwife team phone number & spoke to a genetic midwife who sent it out in the post.

She cannot withhold the form, she’s being very petulant. And risking her professionalism. I’d complain if I was you.. and ask to change midwives. There’s no point continuing with her for either of your sakes if you can’t get along!

Actually my mw did this. Had repercussions with my maternity allowance the bloody cow!!
Speak to the practice manager and ask for a new mw. And tell her exactly why

Mine didn't give me one at all, it was a friend who did my care but messed it up and then went on long term sick and never spoke to me again.
Anyway, I was able to get a midwife who treated me in the hospital to sign it for me. I was there a week before the baby was born. It was all a bit of a mess I remember and can really affect maternity pay. Make sure you get it sorted.

23w on weds. Not cutting it too fine yet but if she creates furthers problems I'm concerned I won't be able to give the 28 days notice required to leave when I want to which is the begging of May. My next appointment when she may or may not have this is on the 30th March.

God that's terrible, and yeah I've only got this appointment because it's my first and worried she won't have it for this one or will make something else up.

She's extremely petulant and childish in her attitude and mannerisms it's really bizarre and shocking.

It's weird right? She's always been really childish and unprofessional but threatening to pass documentation in a name that isn't legally mine is pretty shocking

You dont need the MatB1 to get leave. You need to inform your employer you are pregnant and when you want leave to start by 25 weeks but the MatB1 can be provided after that date

Complain and get a new one Absolutely. Outrageous behaviour. Keep all the evidence.

If whoever you complain to doesn't sort it (which they really should) you could complain to nmc

I got mine signed by my GP as I couldn't get to see my midwife before 25 weeks. It can be signed by either a GP it midwife

Weird your GP surgery does not do it, mine did with no problems as my midwife is unreachable and in 2nd pregnancy I never see anyone anyways, my GP only requeted I bring some sort of proof (my pregnancy book with the dating scan) and 5 minutes later I had the certificate. GPs can definitely issue them.
Tell your employer when you want to go on maternity, the MATB1 needs to be given to them at least 3 weeks I believe if you look at the government website (my employer said 4 weeks) before you want to start your maternity, but you need to give them the date when you start your leave on or before the 25th week.

@Bol87 it would not be too late for work in your case, you need by lawgive it 3-4 weeks before you want to start maternity leave, it's just you need to give them notice by the 25th week about when oyu want to start. There is a lot of misinformation about the dates on the web and I found many of the sources stipulate you need to submit MATB1 by the 25th week which is incorrect.

Your midwife should be able to give it to you, or leve it at the surgery for you to collect, after 20 weeks.
You might need it for different things.
For example I claim maternity allowance so I posted mine at exactly 25 weeks so it can get sorted in time. Also my husband needed to show it at his work as proff of my due date for his paternity leave.
So your midwife should be able to give it to you after 20 weeks if you ask for it.

The other employer doesnt even need to see the MatB1. No proof of pregnancy is required for paternity leave/pay

Claim Paternity Leave and Pay through your employer. You do not need to give proof of the pregnancy or birth

Oh really? It's not for leave it's for mat pay. I'm mostly concerned with my pay being messed up as I've been told by HR this needs to be provided 28 days before I want to take my leave to implement the pay.
