Husband has missed paternity form deadline...

This has been a bit of a complicated twin pregnancy (involving weekly checks with the consultant and very intensive monitoring) and DH's work have been brilliant about it, letting him swap shifts to come to appointments etc, and with lots of contact with his manager who has been very supportive and interested. She said he can definitely have 2 weeks holiday added onto paternity leave whenever it happens, so she knows he intends to take it. But I suddenly wondered this morning whether he should have made any formal request for the paternity leave/pay... and it turns out the answer is yes, by 25 weeks! He said manager has never mentioned any forms and he just hadn't thought about it, as things have been so unpredictable. I'm nearly 30 weeks now and the twins will be here within the next 6, but we were told to prepare for delivery any time from 25 weeks... that's how unpredictable it's been.

Is there any chance DH can still get the full pay offered by his workplace, or would payroll just say no as he never submitted a form? His work is shut til the new year so got a few days of worry now until they reopen to clarify!

I had a similar situation, DP works in a relatively small company and only one person has children there. He was asking about the process of taking paternity for a while, since I was about 16 weeks, and kept getting told they were looking into it. At just before 30 weeks he asked again and they said he'd have two weeks full pay?

Noone can tell you as it will be up to them whether they let him apply late. At least they are aware of the pregnancy and have been understanding so far

Nothing you can do but ask after Christmas I’m afraid.. legally, they can say no but it’ll be at their discretion. Sounds like they are pretty kind & accommodating so fingers crossed!

I would put money on the fact it will be fine. Those policy rules will be in place to ensure that an employee doesn't just inform them the day before and then don't turn up for two weeks. He has kept his employer informed so he just needs to do the formal bit when he returns. Really don't worry, it will be absolutely fine. For context, I work in HR and can't see any reason why they would enforce this policy in this context.

I wouldn't worry. He has informed them even if he hasn't filled the form in. I don't think my DH ever filled a form. I had to give work my MatB1 form and told them I couldn't give it to them by the date as I hadn't seen the midwife to get it. They weren't bothered and just asked for it asap.

Also sorry 1 more thing, I imagine the policy says 25 before EWC which would be at 40 weeks so just because youre having twins and can expect them earlier doesn't mean you should be disadvantaged. Again, don't worry about it, its a non issue.

My husband did too but thankfully they were absolutely fine about it and he's got it booked. He only gets one week paid however, its the holidays for him (he's an academic) so I still get him at home for 3 weeks!

Thanks so much everyone, this gives me some hope that all might not be lost then! :)

With dd. Dh didn't do a form at all. We wernt aware we had to. Luckily his boss just paid him full pay and never registered he'd been off.. A company of just 10 staff

His current job he just missed the deadline.. But there's only boss no1, boss no 2, his wife. And 1 other work there. They have an accountant and the accountant processed the form that day..

Not sure what then happens but die now in 3 weeks
