Hi just after some advice regarding maternity pay/allowance if anyone knows anything.

I'm currently on maternity leave getting smp lower rate. My paid 39 weeks ends on 7/12/2019, but.. I'm not going back till 20/01/2020 due to childcare. So the remaining 6 weeks of me being off will be unpaid.

I'm currently 14 weeks pregnant again, which is a shock!! I've been looking into a second maternity pay/leave which I'm entitled to but to qualify for further smp it stated you need to earn x amount on the 15th week before new baby is due.
Well my problem is the 15th week will be the 22/12/2019, the time where I will be on unpaid maternity. I won't be getting a wage from work again until I go back, 20/01/2020.

Anyone know if I could still claim smp or would it have to be maternity allowance and would I be entitled to that?

I think its weeks 17-25 that would give your maternity pay amount. What amount will you be on in those weeks?

@dementedpixie thanks for your reply. Do you mean from 17wks-25wks pregnant or counting back 17-25 from baby's due date? I'm so confused by it all!

From now up to 7th December I'm on lower rate smp which is £520 a month including my £60 a month holiday pay. I work term time only. From the 7th dec to 20th jan I will be getting £0 smp as my 39wks paid maternity will be over. From 20th jan I will be getting my usual monthly pay from work till I go on maternity again which will be 23rd March

Its calculated using the average of the 8 weeks pay between weeks 17-25 of pregnancy I.e. up until you are 25 weeks pregnant or 15 weeks before your due date

Hi I sent my MA forms off with wage slips and MATB1 form last week and received the message today to say they have received them , I’ve just seen a post saying you also need a SMP1 form to be sent with application but my employer won’t give me one! But I’ve seen other posts saying the MA claim can still go ahead without a SMP1 form? Will this matter if so what can I do ????

You have to qualify for SMP the same as before..

This is measured on weeks 17 to 25 pay which starts in 3 weeks time if you are 14 weeks now.

I’m now 30 weeks .. my boss refused to give me a SMP1 what can I do ????

Hannah he needs your Mat form to do this and you have sent it to MA.

No sorry I didn’t make it clear I asked for my SMP1 form months ago when I showed my employer my MATB1 form but she still refused after showing . I’ve spoken to HMRC and they Have told me I don’t an SMP1 form with me doing applying for MA through the job centre so should be fine .. Does this sound right ?
