Hi

Just looking into paternity leave and pay for my partner from his employer, I have checked on the gov.uk website and it says he needs to of been employed continuously for 26 weeks to receive this but unfortunately he has just changed jobs and will of been there for maybe 20 weeks maximum by the time the baby is born maybe a 22 if I go over 14 days.

Obviously he will need to ask his employer, but does anyone know if the pay and leave or just the leave can be at the companies discretion as it does not mention this on the gov.uk website just says continuous employment and that’s it.

I’m not sure on how these things work especially for men and/or how the company would recoup the costs from the government for lost wages (if they do) or how they would authorise the time off.

I know where I stand with mine at least but now a tad worried about him not been able to spend the first week with me :(

He will be entitled to time off to attend the birth. It would be a hard employer who would give him no time off just after though would be without any pay - although employer could offer that if they wanted, I doubt they would. The statutory pay would be something they could claim back from the government, but they wouldn't be able to because of the job change. How is his employer about booking annual leave, as that would be another option.

If he doesn't qualify then it's at their discretion so best to ask asap. He could ask to take annual leave or unpaid leave? Or they might be generous, this happened to my husband and they gave him a week paid and a week unpaid.

This is what my partner just said he will have to save any holidays he can accrue and use them, he has a shit down at Xmas time so now I’ve had a think about it it won’t be so bad as he would be off for a week for Xmas a few weeks after I give birth. Just fingers crossed I don’t have a complicated labour or end up having to have a section as I’ll need him more to help with the baby

It is at their discretion, but they wouldn't be able to claim the money back from the government. He could request unpaid leave or to use some annual leave, but again it is down to the employer how flexible they are
