My husband employer didn't ask for it which is lucky, as my employer kept the original and I didn't make a copy!

Teddybear45 · 10/05/2019 10:20

Yes they will. But they will accept a copy as the original tends to go to the mother’s workplace

Comefromaway · 10/05/2019 10:26

No, your partner will just need to give written notice of his intention to take paternity leave, possible on an SC3 form whichis downloadable from the government website.

If you wish to share your maternity leave he will need to provide a copy of the birth certificate and the details of your employer along with written notification (again this might be in a specific format requested by his employer, we have a form we ask them to fill in which contains all the details required by law.)

A father's employer has no legal right to see a MATB1 form.

Winterfellismyhome · 10/05/2019 10:28

My DPs work wanted one

Teddybear45 · 10/05/2019 10:38

Yes my DH’s employer requires a copy too, as does my employer for paternity leave. Both both organisations provide 4 weeks minimum pat leave with the option to take holidays on top. I guess the places that only provide the bare minimum wouldn’t need to see anything extra?

Teddybear45 · 10/05/2019 10:39

Paid not pat

Comefromaway · 10/05/2019 10:42

They really are sailing close to the wind legally demanding to see it.

Karigan195 · 10/05/2019 11:51

Thank you everyone. I have no issue providing a copy so will take one just in case as it sounds possible.

At what point in the pregnancy do you receive the form usually?

Karigan195 · 10/05/2019 13:56

After 20 weeks. Differs in some areas though as to how long after

My area only issues after 25 wks (i think to do with the miscarriage /stillbirth cut-offs, and associated ability to have maternity leave/pay)

Tobebythesea · 10/05/2019 18:04

The form needs to be in with your employer by 25 weeks, 15 weeks before birth.

dementedpixie · 10/05/2019 18:05

No it doesn't. You have to inform them of your intention to take maternity leave but they don't need your MatB1 at that point

dementedpixie · 10/05/2019 18:07

From .Gov website:

You need to give your employer proof of the pregnancy to getSMP. You do not need it for maternity leave.

Within 21 days of yourSMPstart date (or as soon as possible if the baby’s born early) give your employer either:

  • a letter from your doctor or midwife
  • your MATB1 certificate - doctors and midwives will give you this no more than 20 weeks before the due date
