The weeks they count for you to earn maternity pay?

My manager said they count the 8 weeks 15 weeks before your due date.
So weeks 18-25.

Do they have to count weeks 18-25?

Can they count weeks 15-23 for example?

As far as I understood it from the head of HR where I work, the 8 weeks before the 15 weeks thing is a restriction set when working out your SMP so they can’t change it. Not sure how it would work if you get payments on top of that from work though

For us it was the 2 paypackets prior to week 25 so could involve work paid in arrears before then.

It's what you get paud between 17-25 weeks and it has to be those weeks

The two pay periods before week 15 - so mine fell in April, they took the average weekly earnings from my February and March pay. Obviously this is based on me being paid monthly.

I’m a teacher and for us it’s weeks 17-25.

For smp yes it's those months. Annoying as this is what is used to work out your average earnings so you can lose or gain by this
