Not entitled to maternity pay 😢

So I've just qualified as a staff nurse so don't start my post until August 10th and I've just found out I'm pregnant 😢 I've never been more full of stress and worry it's making my physically ill and can't stop crying 😭 what do I do? What am I entitled to I don't even think I'm entitled to maternity leave never mind pay!!

You will be entitled to maternity leave, it’s just the pay. You may be entitled to maternity allowance, see calculator here.

I think there is still something called Statutory Maternity Allowance that you can receive if you don't qualify for SMP. Have a look on the .gov website or google stat. Maternity allowance. Your new HR dept should also be able to offer some advice. Congratulations on baby and the job!

No, everyone is not entitled to SMP!
Some can get SMP, others can get Maternity Allowance (which is only less than SMP for the first 6 weeks, after that they’re identical) and some don’t get anything. Depends on your employment and earnings.

When are you due? If you’ve worked a certain number of qualifying weeks, you should get maternity allowance.

You may be eligible for maternity allowance. You will be eligible for maternity leave.

You say you've just qualified as a staff nurse, did you train at and are already therefore directly employed at the same NHS trust? Wondering about continuous employment possibly? Have you spoken to the HR department to get advice?

Ive been on the NHS Bank at the same trust as a nursing assistant for 3 years but dont start my permanent contract until august 10th 😭 going by my last period im 4-5 weeks pregnant so will be due march time 😔

I used to work in the NHS, 15 years ago now though ...... in HR, and our bank staff were on they payroll, essentially on 0 hour contracts and included being in pension scheme which as an HR Manager now it me makes me think you could be considered an employee potentially but I really would recommend you speak to your trust HR department. Have you worked regular shifts for them? Not hard given general staffing shortages in the NHS. If you're in a union would also suggest getting advice from them. It's not like you're agency, you're their bank staff. Have you got your appointment letter and contact for the bank role? Worth a read of that too.

Bank staff are workers but not employees. They don’t have continuous service or employment rights. It’s the whole point.

OP, if you’ve earned enough in 26 of the 66 weeks before a certain date you’ll be eligible for Maternity Allowance.

If you’ve been working on the bank, you should be entitled to something. I’m self employed so will get MA. In my last pregnancy, I’d only been temping through an agency but had worked enough to get full MA.

I'm an Nhs bank worker and I am getting SMP. It's obviously not as good as getting proper mat pay but it's still £145 a week after 6 weeks which is better than nothing

I suppose you mean enhanced maternity pay which some NHS and other employees are entitled to.
A lot of people only get SMP (if that) and will have no idea what you mean by “proper” mat pay, SMP is as good as it gets for many people.

You’ll get smp but may not have been there long enough by the time you give birth to get enhanced pay. Bank staff aren’t employees of the hospital.

Are you absolutely sure? You must have some eligibility from elsewhere as your bank work won’t entitle you to it.

Yea 100% sure, I am already off so I have been receiving it for 3 weeks now. they work out how many hours you've done on average each week to see if you are entitled and as I was doing between 40 and 60 hours a week they said I can get it. I work for Mgs Wales tho so not sure if that males any difference

I was in an almost identical situation I was a temp and was made permanent around the time I found out I was pregnant. I wasn't entitled to SMP but I could claim SMA. You have full right to 52 weeks maternity leave however long you have been employed.
