After some advice.

I am taking 35 weeks mat leave then 2 weeks hol then back to work.

We would then like daddy to take 4 weeks spl/apl.

Can we do this or does he have to start his 4 weeks straight after my 35 weeks?

Is there any legal guidance or is it up to employer?

Ive never split leave but as far as I know you have to be back on payroll to take holidays and therefore your entitlement to maternity is then over - so I don't think you could pass it on at that point.

This is from the .gov website:

You and your partner may be able to get Shared Parental Leave (SPL) and Statutory Shared Parental Pay (ShPP) if you’re having a baby or adopting a child.

You can share up to 50 weeks of leave and up to 37 weeks of pay between you.

You need to share the pay and leave in the first year after your child is born or placed with your family.

You can useSPLto take leave in blocks separated by periods of work, or take it all in one go. You can also choose to be off work together or to stagger the leave and pay.

He can take it any time in the 52 weeks after baby arrives but you have to have filed paperwork to officially curtail your mat leave so they know how much he is entitled to and then can take it any time on first year whether you are on leave still or back at work - just sorting out paper for for DH to two extra weeks post pat leave and then 4 weeks after I come off mat leave (part when I'm on holiday before back in office and also when back at work)

One thing your DP needs to check asap is if his employer needs any proof that you are pregnant.

If they do they tend to just want a photocopy of the Mat B1 form plus your NI number.
