Holidays While On Maternity Leave

Hi.

I'm just looking for any information or advise really.

My holidays at work are from Aug to Aug and I get 23 working days, I'm going on Maternity at the mid of October as due in Nob however, I'm wanting to use all my holidays before I start maternity as I won't be going back for a year and don't want to loose them.

I've booked two weeks of before my maternity and was going to book the rest of the time off in September. However, I've been told by a manager that I would have to accure the holidays, so with my leaving in October I'll only be allowed to have a certain amount as I won't have worked the full year even though I'm classed as an employee.

I've looked online but can't find anything legal regarding this, is someone has had this before or knows any information it'd be really appreciated :)

Your leave rolls over when you're on maternity so you should be able to take it at the end of your maternity leave fully paid

I guess they don't want to give you a years holiday incase you don't go back. It's quite normal to accrue holidays during mat leave and take them at the end. So if you have a 9 month mat leave, Sep-May, then you'd stay off in June on full pay using your holidays. You get the same time off as if you used them at the start, but it's just done a bit differently.

If you don't go back you'll still be entitled to the leave you've accrued, it's law.

Yes, this. I didn;t go back after my mat leave and ended up with a decent lump sum at the end as I had a lot of holiday, holiday I hadn't used before I went off and 9 months worth of accrued holiday.

I'm in the NHS, will be taking mat leave Oct-Oct and I've had no problem taking my full entitlement for this financial year before going on mat leave (and will then have more accrued from the April-Oct to take when/if I go back). I don't think dropping to p/t afterwards would affect it as if you weren't going on mat leave I assume you'd have still been working full time this financial year?

I had this even though in my contract it stated I only needed to accrue int he first year.

If they don't give you this option the MUST legally give you you the holiday at the end AND you're also entitled to accrue to bank holidays if you're only given a standard amount of days. I think it's 28 total. Also when you go back you can also add on any holiday you've accrued next year. Including the time you're off too.

You will not loose any holidays (even public holidays that occur while you are off).
You can take them at the end of mat leave or if your company allow you the you can use them to go back less (I went back 3 days a week for 10 weeks but was paid for 5 then I dropped to 4 days)
Your holidays are earned on current hours so if you go part time it should by be effected.

Double check with your company but this is how my work does it and I believe it is because they legally have to.

Unless of course you are a teacher- and then you don't accrue annual leave at all.

I'm due Oct and starting my mat leave at 38 weeks mid Sept. I'm using all my annual leave balance beforehand to finish at 34 weeks. My work are fine with this (I suppose they have to be, legally) but I have just been promoted so they know I'm almost certain to go back afterward.
