If my school won't give me P/T when i return form mat leave and i resign, and get another job in same LEA, will i have to pay back some of my mat pay? I know if you leave you have to usually but am i employed by the school or the LEA? Surely if it's the LEA if i get a job in another school, i have not technically left?

I think it's the LEA. Anyway, clarify it with LEA or with your union, then you'll kmow for definite. I do know that it's now less likely for school to refuse part time because of
'work,life balance'agreement.

cazzybabs · 11/01/2007 20:17

I would take it up wiht your union if they refuse - my school where saying the same thing - no part time, my union said oh yes schools have to have a very good reason to refuse part time. Anyway threat of union and they said oh OK
I would thunk you are employed by your school..but i may be wrong!

Yes you'll have to pay the money back. Even though you get paid by the LEA your contract is with the school.

Contact your union though as they can't just refuse your request

Had a horrendous time negotiating PT when I returned post maternity leave - got the union involved and suddenly it could be accomodated.

Not sure about maternity leave pay but the union will know - also, if PT genuinely not possible could the union negotiate about not paying back pay in the circumstances.

Good luck
