So upset

Just had my first proper weekend back at work after being signed off with HG for seven weeks or so. I was made to work through my lunch break Friday and then cover the evening with a girl who doesn't know what she is doing when I'm physically unable to pick up the slack and my manager is aware I'm still feeling unwell even though I have mostly stopped being sick. Nausea is still bad. This meant I missed half my afternoon break and was under a lot of stress. Discussed it with my manager today, told her all that had happened and got told oh yes I knew you'd have a bad night. I was seething. Only to be made to work through half my lunch break again and the only other alternative option apparently being to work through my entire lunch but not get paid for it of course. So upset and not really sure what to do about it.

Can you just refuse to work through your lunch? It's unpaid so not their time... And you're pregnant so if you're too ill to work they can't really refuse...

Is it legal for you to work through your lunch? I'm sure that my pregnancy risk assessment is breaks often, not to work through lunch break and no working longer than contracted hours. I would look into that if I was you

I think I can probably refuse. I didn't because in all honesty I felt rough and couldn't really face the confrontation. I don't know if it's legal actually. I'm thinking I will have to go into personnel and discuss it. I don't want special treatment for being pregnant but I think I should get my basic rights. A thank you or an apology for the terrible Friday evening would have been nice as well.

It's not legal. You are entitled to breaks and the fact that they're requesting you to work them with full knowledge that you're a) pregnant and b) unwell, puts them on very dodgy ground. Tell them you need a break - there is absolutely nothing they can do about it. Sorry they're being so rubbish.

MummyBex1985 · 11/10/2015 10:55

No, it isn't legal. You're entitled to at least 20 minutes unpaid even if you're not pregnant. As you're pregnant and need more breaks they are taking the piss!

Speak to HR - you'll only end up being signed off sick if you aren't treated properly at work.

Being signed off sick again wouldn't surprise me at all. I feel awful today. Sick, dizzy, headache and general exhaustion. Definitely won't be able to keep that up even if I wanted to. I hope to catch one of the ladies in HR tomorrow all being well.
