Hi

I've heard that the law changes in April to give every mother 9 months statutory paid leave rather than six.

My baby is due on 27 March! Does anyone happen to know if I still qualify if the baby is born before the change comes in. Or should I be crossing my legs for a few weeks?

the laws changed when my dd was born she was due in may but was born in march and i still got the extended becasue they went on due date. dont know if this is the same, i knew people at the time who were asking the friendly mid wifes if they were a few days short at adda few days on there maternity certificate. doubt this helps but when i had dd my employer went off my maternity certificate

I would say that it wouldn't apply to you..knowing the law and when changes are made like this they are quite strict on dates etc. Someting was introducted when I was expecting dd and there was a date it was introduced..babies born a day before this date didn't qualify sadly..think it may have been the extra in mat pay..mmm not sure..

I would check with your empoyer/HR as they will confirm it 100%.

Hi Padi,

You will qualify depending on your EDD (estimated due date) - so unless you can persuade them to change yours to after the first of April, it doesn't matter whether your baby is actually born before or after the date - hope this makes sense!

Think it all depends on the descretion of your employer. Where I work it changed from 6 months full pay maternity to 7 months a while ago and all the women who had had their lo's within 6 months of that date got back the 4 weeks to take in full whenever they wanted.

unfortunately you don't qualify for the 9 months - sorry! It is based on your estimated due date and this must be on the 01 April 2007 or after to qualify, it doesn't matter when your baby is actually born i'm afraid! I know this as i'm due on the 18th april 2007 and do qualify for the extended leave, but early on when i was unsure of dates and there was a chance i would be due 21 march 2007, i was told if this was the casethen i'd miss out sorry to be the bearer of bad news! Maybe you could pay the midwife to change the due date a little, lol! {grin}

I read of this on here a few weeks ago, my due date was 30th March, so I changed my dates when I had my booking appointment . Of course if my scan next week pushes it back I'm in the same boat as you. I'm hoping it will be the same as with dd1 when my dates were moved from 8th March to 18th (she came on 29th). But that year I lost out with the April deadline also.
Sorry it didn't work out.
