You'd probably get a better response posting this in employment affairs? :)

Popinda · 25/06/2012 15:27

You can claim smp from both your employers! So you get double! That's what I'm going to do once I get my bfp! Grin

FluffyJawsOfDoom · 25/06/2012 15:30

No you can't Hmm you're only entitled to it once.

Popinda · 25/06/2012 15:35

That's not true! As long as you earning the minimum weekly wage you can claim from both employers. Smile

PrincessWatermelon · 25/06/2012 15:56

You can claim from both. I will be. As long as they're not part of the same organisation and you meet the requirements for each job separately.

However, I don't know if you can start ML and claiming from one and then stagger it to claim from the other a week or month later (not sure if this is what you're asking in your opening question). I'm starting and ending ML on the same day with both jobs. I think you may get into difficulty as you can't earn anything other than SMP whilst you're claiming it. If that makes sense!

MissKeithLemon · 25/06/2012 16:06

You can claim SMP from as many employers as you meet the qualifying criteria for...

The start of ML for each one would be as agreed beforehand with each employer and again as per the rules (ie sickness can trigger ML to start early etc)

You can have KIT days for each employer too,

I did post in employment didn't get a response? What if I can't get smp from my part time job ? I dont want to loose the job but also don't want to work there for free? I get like £390 a month after tax?

OP posts:
Popinda · 25/06/2012 16:18

I don't think that's enough to get smp. I think you need to ear about £140 a week before tax.

FluffyJawsOfDoom · 25/06/2012 16:39

Wow I'm genuinely shocked and wishing I'd started a 2nd job before ttc! Sorry to derail your thread op x

Cheekychops84 · 25/06/2012 16:53

Ok popinda on more thing so I can continue working for one and getting smp for the 2nd but do I have to tell my employers what I'm doing and inland revenue? Or do inland revenue just work it all out?

fruitybread · 25/06/2012 17:00

Just to butt in, sorry - I think the issue may be that you can't be working AND claiming SMP at the same time. So yes, you could claim from 2 employers if you were entitled to - but you couldn't stop working for one, start claiming from them and then carry on working part time for the other. If that makes sense. It would have to be both at the same time.

I could be wrong - I haven't looked into it for a couple of years, but had to research my own position VERY thoroughly when I got MA (am self employed but carried on earning money from my business when I wasn't actually working in it myself. Which is allowed. It's just that you can't actually be working if you want to claim a benefit based on you not working).

Popinda · 25/06/2012 17:05

Fruitybread is right. You can't work for one employer and get smp from the other. Do you get enough money from the other employer, because I think you won't be able to claim smp if he also pays you only £390 a month.

Cheekychops84 · 25/06/2012 17:09

Works out about £102 a week?

I have 2 more links here :

maternityaction.org.uk/sitebuildercontent/sitebuilderfiles/morethanonejob.pdf
maternityaction.org.uk/sitebuildercontent/sitebuilderfiles/morethanonejob.pdf

Also spoke to hmrc a while back and they said I could

MissKeithLemon · 25/06/2012 17:14

Exactly how much do you earn in your part time job cheekychops? If its £390 after basic rate tax is taken off you may well qualify for smp from that job anyway...

Fruitybread - I think you may be right about not working whilst received MA, but smp is slightly different in that it is due (providing qualifying conditions are met) to be paid by the employer once the conditions are met, whereas MA is a state benefit payment.

MissKeithLemon · 25/06/2012 17:16

Cheeky - what tax year did your qualifying week fall into? (15th week I think)

Cheekychops84 · 25/06/2012 17:20

I earn £445 before I am taxed

OP posts:
Cheekychops84 · 25/06/2012 17:21

Read the other two links and see what u think maybe I should ring hmrc again ?

OP posts:
Popinda · 25/06/2012 17:23

You need to be earning around £680 before tax. You can't work while on smp.

MissKeithLemon · 25/06/2012 17:25

ooh, luck you! So if I've read correctly, you earn ££445 pcm from your part time job yes?
Get your matB1 in pronto and enjoy both sets of smp Grin In order to receive smp you need to be paid at more than £102 per week (Lower earnings level for 2011-12) so it seems that you will also receive smp from this employer!

Here's a useful link www.hmrc.gov.uk/manuals/spmmanual/spm20250.htm Just have a look around HMRC website for all the relevent notices and get them printed off to peruse at your leisure!

Cheekychops84 · 25/06/2012 17:26

So what do I do quit my 2nd job? As I dont see the point working there for free?

OP posts:
MissKeithLemon · 25/06/2012 17:26

£680 before tax Popinda? I may be wrong, its been a while since I worked out smp for people, but just for clarity where have you got that figure from please?

Yorkpud · 25/06/2012 17:29

When you say you can claim it from 2 employers I am assuming that you are just getting some of it from one and some of it from another not double the money?

Cheekychops84 · 25/06/2012 17:29

Thanks miss lemon but I have stupidly told
My 2nd job up until now I wasn't taking maternity leave :/ so they can now turn around and say I haven't given enuff notice ? She is going to call me tomorrow and tell me if I can get smp :/ also this was in there what does this mean:

If a woman is entitled to SMP from more than one employer and the employers are not trading in association, she may work for one employer and still receive SMP from the other. If she uses her KIT days, see SPM21106

OP posts:
MissKeithLemon · 25/06/2012 17:31

No Pud, its double the money Grin
