Can someone check my maths please re. SMP?

Hi

I'm going through redundancy and I'm going to ask if they will mark my leaving date as far enough along in the pregnancy for me to qualify for SMP (solicitor's advice).

Anyway, I need some help working out what date this would be. I'm due on the 31st May. This is based on my 12 week appointment. Might it change again at my 20 week scan? This on the 5th Jan (19 weeks).

This is information about the qualifying week for SMP:
SMP is payable to those women who have been employed by their employer for a continuous period of at least 26 weeks into the 15th week before the week in which the baby is due.

So, would that make my qualifying week the week commencing 13th February?

Any help is much appreciated.

I'm not sure but I had a bash of working it out, and as long as you have been working there for 26 weeks before your SMP starts which by my calculations ur right, week commencing 13th february, you will be 25 weeks, I think you need to talk to your employer and your solicitor or Citizens advice bureau to find out your rights

Got this off Direct.Gov

If you are made redundant or you leave your employment
If you are entitled to SMP and you are made redundant or you leave your employment after the start of the 15th week before the week your baby is due but before the start of the 11th week, SMP will start from the beginning of the 11th week before the week your baby is due.
If you leave at any time after the start of the 11th week before the week your baby is due and before the start of your Maternity Pay Period (MPP), your SMP will start from the day after you left your employment.

I think as long as they don't make you redundant before you are 25 weeks, you are entitled to your SMP, if you stay until your 29th week I think they put you straight onto your maternity leave. I find it really confusing, i've left it to wages and personnel to sort out. Sorry for the double post chick x

Here's the calculator www.hmrc.gov.uk/calcs/smp.htm. I worked mine out by pretending to be my employer, you put your due date in and it tells you all your significant dates (like when SMP will start, end, etc).

Thanks so much for the responses, plus the link.

That calculator is very helpful, and it seems I was correct in my calculation, so the baby brain hasn't got me yet.

Now I just have to wait and see if they will be obliging to move my last date of employment to the 13th Feb.

glad it helped, I found it really useful as I did overtime during pregnancy which bumped up my first 6 weeks SMP to a lot higher than my usual weekly wage. Allowed me to financially plan better plus I knew what I should get if my employer messed up the calculations (they're forever cocking up someone's wages!). But really handy for the important dates you need to know, better than working it out yourself.
