Paying back maternity pay if you don't go back to work

Hi I'm a primary teacher and will be finishing work at Easter for Mat leave. I think I'll get 6 weeks at 90% pay and 12 weeks at half pay. Due to changing personal circumstances I may need to move to another part of the country during my mat leave and so I'm wondering what happens if I have to leave my present school and find a job in a different LEA at the end of my Mat leave. I know I'll definately have to pay back the 12 weeks half pay but what about the 6 weeks at 90%? Hope someone can help!

6 weeks at 90% is standard, you won't have to pay that back.

you would be liable to repay any maternity leave paid to you during your ml with the exception of accrued holiday.

I think the 6 x 90% is standard so you wouldn't have to pay that back. I have a deal similar to yours, and if I don't come back, I need to repay the difference between SMP and my half pay, for the 20 weeks (in my case) when I am getting hald pay, as this is the 'extra' my employer has given me over and above what they have to.

Hiya, I work in HR.. found this link for you which summarises your rights:

In short, you only have to pay your maternity pay back if it was over and above the statutory rate AND stated in your maternity policy, contract, or otherwise agreed.

I work for a large company that pays full pay for 6 months + statutory amount for the next 6 months and none of that is repayable if a woman doesn't return to work. I have always worked for large blue chips and never once heard of any company requiring women to repay... but unfortunately working for a school might be different.
