The SDLT calculator on the gov.uk website asks all the questions necessary to correctly calculate the amount of stamp duty to be paid, but relies on the answers given to be truthful.

For a £800K house the figure is £30 if it’s your only property. If the purchase of the £800K means you have 2 or more properties the stamp duty payable is £70K.

This is where AR was untruthful. She attempted to hide the known fact that she had more than one property.

But it wasn’t that straightforward was it? There was the complication of the first house being in a”trust” for the child.

Which she still claimed as her constituency home and main residence for council tax purposes.

Whichever way you cut it, something doesn't work. At least in the spirit of the law.

Hence the good advice to get specialist advice. Which for some reason she chose to ignore.

She has to know that claiming one house as main residence for council tax while simultaneously saying a second property is her only property stinks like a kipper

If you’re involved in a trust in any way you know you have to get detailed, specialist tax advice. She was - or so the ethics enquiry found I believe- expressly advised to obtain that specialist advice on more than one occasion, by the solicitors acting for her in the house purchase (since they were not specialists in tax& trusts).

Yet she chose not to do so.

One can only assume this was because she really did not want to find out what the true tax position was.

What other explanation is there?

The enquiry fell over itself to be charitable to her and still found she had breached the Ministerial Code of Ethics (bit of a joke concept really, Ministers and Ethics in the same sentence).

Wilful blindness is not an excuse.

Of course, she’s not alone in politics in being a shameless, unprincipled grifter out for all she can get. She’s been exposed on this occasion for a reason- probably to either promote Wes Streeting, or to cause chaos & increase the likelihood of an early election before the Greens under Polanski & the new party establish themselves- ie to increase Reform’s chances of winning next election. This fact does not make her any less contemptible.
